Can I recover bank fees for going into overdraft?

Hi there, I've just discovered that I have been getting charged £25 each time I make a transaction on my account when my account is overdrawn.

£125 this month, and looks like it has been at similar levels for a while now without me realising (yes I am useless).

Is it possible to get some of these charges back? They seem to be excessive and I definately cant afford them.

    yes you can claim these back along with any other "cleared transaction fee" etc etc

  • I took Halifax to court and won £4070 + interest. Hit them for the lot is my advise.

    Thanks for this, but it says that if you're not in financial hardship, then the banks wont pay out until the 'test case' is decided.... which could be years right?

    You never mentioned financial hardship so I got you the link for reclaiming bank charges(standard one).
    I have not worked for NatWest Bank since February 2009

    Yes... which is the correct link.. but the link says that unless you are in financial hardship (which I'm not - well have no assets and no debts at least), the banks wont pay out...

    So if I lodge a claim for bank fees, and given that I am not classed as being in financial hardship, the banks wont actually pay me back my fees?

    Even if you are in financial hardship the bank does not have to pay back even 1p of the charges until the conclusion of the OFT test case issues which are currently ongoing.

    so its best to wait for the outcome of the test case then? seems a lot of effort to go to if the test case loses...
