    You say in your first post that you are executor of your late partners estate.
    Are there significant debts that remain to be paid off as part of the estate and if so how are you managing to do this?
    If siginificant debts remain then you could argue that repayment of the charges to your partners bank accounts are required in order to settle his estate.

    If this is not the case and you are really only seeking repayment of the charges in order to create a nest egg for your son's future then, to be honest, you might as well just wait until the test case is resolved.
  • There was been quite a number of debts left, I sold our house to pay of any debts left in joint names & these are now all cleared. anything else just in his name is being sorted via the solicitor out of the estate.

    I guess no harm in trying, however as you say maybe best to wait....
