Landlord wants entry, has given notice but I'm not happy with date

  • dcmonline - to be fair, it looks like you and the landlord are in competition to see who can inconvenience the other the most. Now maybe you feel that "they started it" but that really isn't justification for joining in.

  • Sorry but I think you should get this inspection over and done with. If you are insisting it cannot be done for several weeks, then this not allow adequate time for you or your landlord to resolve any issues with the property condition, especially as you will be out of the country.

    As for the rent, you should pay. You have signed a contract agreeing to do so and as you are aware of the bank error, there is no reason for you to not rectify the situation and pay now.

    Did you try to explain to landlord why the particular day is so inconvenient to you ans asking him to consider a different day, maybe suggesting the one that would suit you more, or did you just replied that no, you can't come on X, you can come on Y. I find that usually a good explanation to landlord why you can't make on a particular day is good enough, and they are willing to agree convenient time them. But if there is no good will formthe tenant, landlord will not show any good will either...

    From your replies it looks to me like you are forcing him to accept your insisted day!

    No, you have a fair point on that. As has been said, you have the right to quiet enjoyment of the place you are renting and I think they can only visit without your agreement in an emergency, but I was referring to your non-payment of rent.

    Yes I did. They responded with a letter informing me that the inspection will take place on the date they have dictated. They appear not to be acknowledging my corresponances now. - C

    If you don't physically exclude them they will let themselves in. Now they should not do this as you have refused the appointment (in writing I hope) and offered alternatives. Thing is you won't get any redress for one breach of theirs so time to get a changing those barrels IMO they have given you good reason to do this. Alternative but less effective is a shed alarm. Or stay in with the chain/internal bolt or whatever on. Google "quiet enjoyment" to see under what rules you are allowed to control who has access and when. As inspections are part of the agreement you should offer to agree an alternative date that suits both parties which you have done.

    This will tell you if unauthorised access has occurred and also can re-enforce the message that they shouldn't be there.... LOUDLY...

    Thanks for some sanity Clutton. Tenant is about to leave, has withheld rent, and is being advised to change the locks and barricade themselves in!

    Only if the rent is paid.
    They are actually thinking of witholding the rent.
    This is why is looks like they are going to do a disappearing act. The landlord knows this and is the reason he is coming 'ready or not'.

    I would do the same if someone was about to rip me off.
