yes i also filled in the allocation questionnaire, did this myself as cant afford a solicitor, no case law quoted just the facts that i admitted in part but asked for the rest of the amount not to be taken into account as this was in dispute and on hold pending the outcome of the bank charges reclaim appeal.Focusing on clearing the credit cards in 2018 :T0

You can set aside the part of the judgment that was defended. thats all needs to be done, and the only part of the case needs to continue.
You admitted part of the claim, the claimants said ok we'll go with that and asked for judgment on that part, the judge passed judgment on the whole lot.
Was this decided in the court room and did you attend ? On the general form of judgment or order did it state the defence was struck out ? and was the judgment for forthwith payment ?
You can also apply to the court for redetermination (basicaly asking the court to order installments at your £125 odd rather than forthwith) on the amount you admitted, whilst setting the rest aside for a stay.
Really NEED to see your defence and know exactly what happened to be able to advise properly.LegalBeagles0 -
Hi, yes the defense was struck out and judgment for payment forthwith.
Still nothing back on if the sols have accepted the payments, but i did get the form from the court to ask for redetermination if they decide to decline my offer.Focusing on clearing the credit cards in 2018 :T0 -
