DVLA penalty - read this

DVLA = what happens with penalties (all info correct at time of post)

the 3 types of penalty the DVLA will issue

1 = 7A = £80 pen (reduced to £40 if paid quick)
DVLA issues penalty automatically if you are the owner/keeper of a veh un-taxed or un-sorned for 2 months. pay and they close the case, dont pay, they set the debt collectors on you. back tax is TOTALLY VOLUNTERY, they cant make you pay it, but be warned, if your car comes up again, they will persue the lot, plus court costs plus element of penalty. its a good idea if you can pay, do pay it. if things are tight, then dont, but dont ever let your car run out of tax again.

2 = 29 case
if you get spotted anywhere (off road or on it, private land or not) without tax, the police or clampers can and will take action. then, the report gets sent to the DVLA and they will offer an OCS (out of court settelment) on top. this amount will vary from case to case. if your veh has only just run out of tax, then it will be small penalty, pay it and your case is closed. dont pay it, they will take it to court and get costs, plus the penalty plus extra. if you can prove your car is on private land (that not maintianed at public expense) they will close the case - no further action.

3 = 22
stealth case.... if you (as a registered keeper/owner of a veh) fail to notify disposal, this means YOU, and YOU ALONE (not dealer, or wife or lady down the road) must send details of the sale to the DVLA. if you dont, they will hit you with a £55 pen (reduced to £35 if paid quick) they also persue this case through the court.

remember, the DVLA can only write to the address they have on record for that vehicle, so if you moved and didnt send off your logbook, it could go to debt collection or a county court judgement without you even being aware that there was a problem.

if you get a 7a penalty (80quid) when you call them, be nice, you could sweet talk yourself into paying the lower amount even if the date has passed. pay the penalty, then think about the back tax.

  • Interesting. They're after me for allegedly failing to tell them I sold a car. Despite the fact I did, and they refunded me the unexpired portion of VED. I told them this when they sent the fine through initially. They ignored it and put Moorcroft ( a DCA) onto me. I told them the same and they stopped writing to me, however I received another letter from them (moorcroft) about a month ago.

    I'm happy for them to take me to court as I still have the cheque they sent me for the unexpired VED (the dog chewed the corner and it was uncashable but it was only about £20-ish) so I'm confident I could prove I did send the documents back and it's been their mistake.

    hiya - dont shoot the messenger but the fact that you had a refund proves just that, you had a refund. it tells the DVLA that you wont be using your veh on the road for the remainder of your tax disc. it sounds to me, like they didnt receive your reply where you stated that you did notify, try writing again, but to DVLA not moorcroft, they is vicious...
