Item not received sleers listing now state they are on holiday for 2 weeks!

Hi, I bought a kit for crafting on a BIN and paid immediately 2nd August, I also bought several other items with the same seller also on BIN on the same day and paid via pal pal instantly. I had 2 separate notifications that my items had been shipped on 3rd August, one for the combined items and one for the kit. The combined items arrived on 6th August, but as yet the kit has not arrived.
I have received post every day including lots of packets and parcels that were shipped after this kit (from other sellers) and am told that there's no backlog of any parcels or packets at the delivery office.
When I checked the listing to contact the seller and advise non receipt I saw that there was a notice on their shop that they are on holiday now and away for 2 weeks.
I'm not sure now how to proceed, the seller has a good reputation, I was very pleased with the quick delivery of the combined part of my order, and I suspect that there's either been an oversight on their part or that the kit has genuinely gone astray in the post - however, I really did want this kit to start a project I have been asked to do, thats why I chose BIN I've already been waiting a week for it and now the sellers are away thats a further 2 weeks before it can be even looked into by the seller and then a further delay whilst they send another kit (assuming that they agree to do so).
I know I could open a paypal dispute but feel a bit mean doing so as the sellers being away mean they cannot respond to it, but if I don't open the dispute am I potentially losing out on an opportunity to claim just in case the seller doesn't respond favourably on their return?
On the other hand I do want to get on with my project and don't want to be waiting for another 2 - 3 weeks for a new kit to be sent out. This is a powerseller with over 41k positive feedback.
I am thinking of buying a kit from another seller purely so that I can get on with what I need to do, but then I would want the original seller to agree to refund rather than send out a replacement item as I certainly don't need 2 kits!
What would you advise is my best course of action?

I wouldn't bother reporting them unless after 2 weeks they still haven't sent it. I would not leave them postive feedback as its stupid selling while your on holiday. Or at least send all your items before you go. If they are a powerseller there is probably a number of you in the same boat.0

Personaly i would open a paypal dispute. The seller was stupid for not sorting this out before there holiday. Maybe haveing an open Paypal dispute when they return may teach them and get them to get there !!!! into gear0

When as a seller you go on holiday sods law applies. I used to pick up my annual dose of negative feedback in situations like this. The joys of being a one man band.
If you need one urgently buy again and pick it up with the original seller once they get back. There is no point in doing anything else at this stage. Unless you want a fight of course.0 -

If your selling on Ebay and you know your going on holiday then you should end all your listings 10 days before you go to make sure all the slower buyers have time to pay and get their items out. I think if you sell so close to your holiday you can't send them out before you go you deserve negative feedback.0 -
I emailed the sellers as their shop said they had email access on holiday - heard back from them last night stating that the item had been sent before they went away and was probably lost in the post, they have offered me a full refund or a replacement kit which can be sent out on 17th August.
It's a fair response and no quibble, but having spent last night looking for something comparable at the same price without success (which is why I went for this kit in the first place) looks like I am going to have to wait another 10 days before I can start my project - which is a bit frustrating.Win's so far: Cadburys Mini Eggs £1.09 Pentel Goody Bag £10 , M&S Luxury Hamper £45, 10,000 Tesco clubcard points (£100) :j0 -
A bit of an update and some advice needed on the feedback I should leave for this transaction.
Sellers had emailed me and stated they would send me out a more expensive kit on 17/08 as compensation for the delay whilst they were away.
I agreed to this.
However, by 20th I still hadn't received anything and sent a polite email asking if the item had been sent, they didn't reply, I emailed again mid afternoon on Friday 21st after yet another post had come and gone with no item. I got a terse 1 line reply late in the evening saying the kit was on it's way - no detail given as to when it had been posted.
Saturday the kit finally arrived - this was the original kit I had ordered and not the larger kit they had promised as compensation for all the delays. To be honest had the kit been all in order then I would have left things at that as I had got what I had paid for, tho I was considering a neutral over the extra delay, however, I started to use the kit on Sunday - one of the tools supplied isn't fit for purpose it will not cut anything, then I opened a pack of fittings and probably 80% of them either won't open or won't close and cannot be used.
Unfortunately I had by that point used some of the other components in the kit so I cannot return the kit for a full refund. I instead emailed the seller to advise that I was unhappy and very disappointed in the service received so far and asking them what they proposed to resolve the issue - I have not received any response to the email tho to be fair it was sent on Sunday so they may not have seen it until today.
This has been dragging on since 2nd August the delay initially was irritating, but the further delay, the lack of the promised upgrade and the fact I had to chase them up again after they got back from holiday plus the items that simply aren't any good and I am now out of patience and starting to get annoyed.
Would you give them any more time to resolve the matter?
Is there anything I can do given that I have actually used some of the items in the kit?
I am seriously considering a negative for the transaction - it'll be the first one I have given in over 6 years of using ebay, would you give a nuetral or a neg?Win's so far: Cadburys Mini Eggs £1.09 Pentel Goody Bag £10 , M&S Luxury Hamper £45, 10,000 Tesco clubcard points (£100) :j0 -
CONSIDERING a negative? So many things have gone wrong with this transaction that I wouldn't think twice about leaving negative feedback at this point.0

Look at it from the sellers point of view...
They shipped you two parcels on the 3rd August.
You were pleased with one. The other got delayed in the post through no fault of theirs.
Their reaction was slow, but then they were on holiday, and of course the kit arrived in due course.
They must think you are the buyer from hell.
As you said they had a good reputation, I would suggest an extremely polite message about the faults in the kit and see if you can negotiate a part refund or a reduced price on another one.0 -
Buyer from hell? I could have negged them when the item failed to show up originally - I didn't, I could also have demanded a full refund, I didn't, I was polite and I was very patient and gave them time to sort it out, even when the replacement didn't arrive quickly after they had RETURNED from holiday I remained polite, I was polite in my email expressing my disappointment that the kit isn't fit for purpose and they haven't even bothered to reply to me.
Yes sometimes items go missing in the post but they now have several neutrals for shipping delays and incorrect items sent which weren't there when I ordered this kit from them and are for transactions that took place before mine and long before their holiday.
It's odd that the other parcel from them posted on the same day didn't get lost in the post and suggests that they missed the kit out of the original dispatch especially when it would have more than easily fitted in the same padded envelope the other items were sent in.
I must really be the buyer from hell, I pay instantly for my purchases, no waiting for the money, I never send hastners until a full 7 days have elapsed after auction end, I am polite at all times, leave glowing feedback for sellers, often am a repeat buyer, and have never left a nuetral or a neg in over 6 years as a buyer, nor have I ever received a neutral or a neg as a seller, if thats a buyer from hell lord only knows what a good buyer is.Win's so far: Cadburys Mini Eggs £1.09 Pentel Goody Bag £10 , M&S Luxury Hamper £45, 10,000 Tesco clubcard points (£100) :j0 -
You have been very patient and understanding wibblewibble. You're clearly not the buyer from hell so don't take any notice. Have you decided what you will do yet?0
