holiday pay

I am currently on my first day of notice leading to redundnacy , i have in the region of 12 days holiday which im beeing told i will have to take ,is there a law thats states i can get the money instead as this will help a great deal .
Please any info is good.

    As a rule, companies must pay out accrued but unused holiday. Are you required to work your notice or are you on Garden Leave? (ie not required to go into work but still otherwise employed)

    Alternately has the company made a single payment in leiu of notice to you? (ie a lump sum)

    or every other day off with 2 days notice each or some other combination that uses up the days.
  • I'd read the Terms and Conditions of your contracts - employers can state that you take the remaining holiday rather than be paid holiday. If you are on your notice period - and still working then this would be the case. However if you have been placed on Garden Leave then they will have to pay your holiday pay - you can't take holiday when you're technically already off from work.

    The employer can insist you use your annual leave at any point they wish as long as they give you minimum notice required by the working Time Regulations. Ie Twice the amount of notice of the time you with to take - ie 2 days for 1 day off - 2 weeks for one week off.

    If they want you to take the time off in a block at the end of your notice period (for example) as long as they give you 24 days warning, then they can insist you take it.
