Can I make a Claim now?????

Hi, I have claimed from Barclays before and got back £300, Since then they carried on with the £30 charge for a while then they brought in the reserve system which basically meant they still got £30, we saw this as a bit of a con so opted out of the scheme.
We now get a charge of £8 for every missed payment, we are struggling at the moment with money, my wife is on incapacity benefit and I am self employed so my money comes in at different times and I often have to wait for cheques to clear, we regually miss payments and our mortgage we pay off over the month as we never have enough to pay it in one go.
Recently we had 13 of these charges took from our account = £104
They took this in one go even though we only have a £50 overdraft and were in to it, this made us £148 overdrawn, they are taking money that is not there!
My questions are is this £8 a fair charge and can we claim it back?
Can we claim at the moment as we are in financial hardship?
and these charges are just pushing us further over the edge?
Can I claim back (at the moment) £30 charges on a business account that is now closed.
Any advice would be great

Only a court can decide a fair charge
Can we claim at the moment as we are in financial hardship?
You can but unless you have priority debt arrears, it is unlikely they will pay out.

my understanding of business claims(and it is limited knowledge btw) is that you have to rely on UCTA 1977. However you need to compare your terms with the ones from the OFT test case because it is possible Barclays will counterclaim and ask for a strike out if it goes to County court.The business account was just me as a sole trader, thanks for the help.0
