It usually says when you ring "these calls may be recorded for training purposes" so they are mostly covered I would think.controversialmike wrote: »Can anyone tell me if it is legal to record the call without informing the other party?0 -
Sorry, I should have been clearer; It is me that intends to do the recording this time. For my own records.0

I believe you have to tell them if you want to use it as evidence.DS1 12/10/04

Ok, will do! that's probably not going to get the conversation off to a great start but hey, it's what we have to deal with every time we call them.....
Going to type up a letter in response right away. This will be followed up with a phone call again tomorrow to deliver the same points verbally.
Thanks and... wish me luck.0 -
one things guys.....
In the letter I got this morning it says;
"please give me a call if you would like to talk through these points. If we are unable to come to an arrangement, I will give you the details of the Financial Ombudsmans Service so they can consider your complaint independently"
Does this mean they have already shut the book on this one?
In my response letter I am stating the usual "If I do not receive a more favorable response within 14 days I shall be taking my complaint to the Financial Ombudsman"... seems a bit silly if they are already suggesting this?
Cheers0 -

Hi Mike.;)
They should not close the file without actually confirming this in writing.
With Lloyds and many other banks etc they do tend to want us to ring them, so ask that we call them, but I never agree to anything verbally, best way me thinks.;)
Your doing good Mike, good luck.

Call them, see what the have to say, ask if this is their final response on the matter, ask them to put it in writing and then go to the ombudsman if you aren't happy.
The ombudsman can't do much of a final response hasn't been issued.0 -
Seems to me they are offering you to call them and get this sorted by the way they say "arrangement". I would take it as they may be going to offer something as goodwill perhaps. Cannot be sure but it is leaving you an option to get back so certainly not shut the book yet. I would however if it were me keep everything in writing though.controversialmike wrote: »one things guys.....

Hi all,
Right then, I left another message for my manager earlier and the person taking the message knew what the call was regarding as soon as I said my name (so it's obviously been discussed around the bank). I received a call back within a couple of hours and we had a nice friendly chat as form of introduction and to discuss my main points.
She quickly said, once a second letter has been received, she will pass this onto the "next level", no mention of the FOS. She said that she understood my points but this will now be left for others to make the decision of how to proceed.
I made sure I had my input on my reasons for the refund but it seemed to fall on deaf ears after she mentioned that it is now "out of her hands". All seems pretty "text book" to me.
So another letter ("stage 2") was sent recorded delivery about an hour ago....
Thanks for your support again guys and gals, I will be back with more news as soon as it arrives through the letter box
