Can we claim for unfair bank charges after a claim?

I have a similar scenario to Lukey84 that has already been posted.
I managed to reclaim 'unfair bank charges' just prior to the current refund/claim freeze due to the ongoing test case. Whilst I have managed as far as possible to keep within my agreed current account overdraft, the current economic climate has unfortunately left me on occasions just outside this limit and the Halifax are STILL charging me £35.00 per Direct Debit etc. that they have refused to pay plus the usual fees AND interest.
From memory, I think my letter that came back from the Halifax with my cheque for reclaimed bank charges stated that any future bank charges would still be applied at their current rates (£30 - £35 etc). Firstly, can they bind me to this, as although the test case has been appealed AGAIN and still await the OFT's outcome, the amounts charged are way in excess of the £12.00 stated as "fair". Secondly, am I able to reclaim excessive charges from after my successful claim that was previously made?
Please advise.

You are confusing Bank Accounts Charges with Credit Card Charges.
Secondly, am I able to reclaim excessive charges from after my successful claim that was previously made?
