bank charges reclaim. hardship???

I need some advice regarding hardship and bank charges. I am helping a family member reclaim charges for RBS, Just over £700 anyway it is a joint account and one of the account holder is not in receipt of benifits for disability, they are paid into a seperate account from the RBS accout and a small transfer goes over to pay some direct debits from the RBS account. Would she qualify under the hardship rullings. TBH I don't fully understand what constitutes hardship. The couple concerned are mortgage free and live very frugally so are not in 'financial hardship' in the traditional sense of the work because they meet all their bills however their level of income is tiny.
I should say they have received the usual fob off letter from RBS about the court case.

Financial hardship is as such priority debt arrears(mortgage/rent, council tax, utilities) however that does not mean that they should not put in a claim to the bank as it will at least start the process. They can go back to July 2001.0
