Bank charge - we are going under

We tried to reclaim on our bank charges a while back and were told the usual response.
I was quite ill and off work for around 10 months, 4 years ago. Unfortunately this drove us into debt as out mortgage insurance did not pay up - please see my other thread. We gained mounting bank charges and feel the bank was the main thing which made us have massive debt. We did have debt before but our bank charges went into the thousands.
We managed to get £8000 from our parents jointly to pay off a loan we took out but now we no longer have the £8000 and it is not enought to pay off the loan. We have also incurred credit card debts. Sometimes food every month has had to have been paid for on the credit card. We have no lavish lifestyle, we do not go on holiday (never been able to afford).
Is there any way this is hardship? If we could get our bank charges then this at least would enable us to pay off our loan and make headway into credit cards. We really need to get out of debt as it's really taking a toll on my mental health. I work full time, and my partner works 20 hrs/wk. I try to work web design freelance but get little out of it. I'm working more and more and not getting much in return. We have a young child. Each further time we get a bank charge they take £30 + a monthly fee of £35 I think. It is really distressing to know such a large proportion of your wage is going on charges to feed the greedy banker (that the tax payer bailed out)

Mate look im sorry if i sound rude,
but some people whos posts i read on here are just so stupid i dont understand they manage to walk down the street without falling over!! LOL
Why on earth are you choosing to keep paying these illegal charges each month,
but then coming on here and moaning about it and how hard they are making your life??
Heres what you NEED to do on monday morning-
*Go into a different bank and open up a basic plain normal bank account so you can get a debitcard that wont cost you anything.
*Unless you salary is paid into your account on the exact same day that these charges are taken out,
when you get your next salary paid in withdraw ALL of it into cash that same day and just keep it in your house, with £0 in your bank account.
*Once your new debitcard arrives give the new bank details to your employer and have them start paying your salary into there.
Problem solved.
if you dont want to keep paying these charges then just never ever have or ut any money into that account, and you wont ever pay any charges then! lol
(The bank can keep claiming you owe them money, but just ignore them, and if they try phoning you just tell them tto F**K off and hangup on them)
In a few months time they house of lords will delcare their ruling that the charges are illegal, so all the charges will be refunded back to you.
So just dint bother paying them until then.

When I first read the start to this reply I thought, oh no, he comes someone moralising about they should have done x y and z. Then I read that in fact it was the opposite. It was poor advice, backed up with alleged facts that are wrong and poor advice.

A quick legal lesson for you. When you sue a bank in civil court you are looking at the fairness of a term in a contract which would make it unlawful.

NEVER ever ignore them and never swear at them because it is counterproductive. By all means tell them to sue you as your counterclaim is bank charges.

Factually this is incorrect since the House of Lords ruling is whether the OFT can assess the terms for fairness under UTCCR 1999(we are approaching the half way mark in the test case).
So just dint bother paying them until then.

Normally I have to post about moralistic, I'm better than you cos I can budget however this one is about irresponsibility. Angel, this is the kinda advice that those "moralists" love. You prove their point so come on, work with me cos I did agree with some of your posts. Swearing at bank staff is never the way, but telling them to sue you means you know you are right. The "!!!! Off" approach doesn't show any class and doesn't make you any better than the bank.0 -

The cause is your illness and the consequences is the charges due to a reduction in income.
We managed to get £8000 from our parents jointly to pay off a loan we took out but now we no longer have the £8000 and it is not enought to pay off the loan.
What happened to the £8000.00?

Have you got your statements going back to July 2001 yet?
Do you have priority debt arrears(mortgage/rent, council tax, utilities)?0 -
Could be missold. I'm not quite sure if I should be claiming this or claiming that I should have got the mortgage payemnts.
The charges ravaged us financially because we had lost payments due to my illness.
We now have around £6500
I will reclaim credit card debts also, thank you
I have copies of the statements.
We make most of our bills e.g. rent/council tax etc but we end up just working to live because of this debt, which I beieve was at least to the most part due to the bank and their unhelpfulness, and of course the charges.
It's amazing how nice the bank is to you when you're earning again.
Looking forward to any other info.

PPI I'd claim as missold - just simpler - why wouldnt they pay out originally ?
Yes reclaim charges, I dont think you;d get it under hardship though. C/card charges you can go ahead with now.
You could try making a full and final offer on the loan of what you have - I'd combine a letter asking for a reduced payment, stopped interest etc because of your financial position with an offer for full and final settlement (in the alternative)
