Argos Sofa Bed

Hi all,
Hope somebody can help. Back in Jan i bought a L Shaped Sofa bed from Argos. The item is hardly used maybe once a week if that as it is in a spare room. Recently i noticed the seating had started to fail over one of the double seats... although nothing is broken. So now when you sit on one of the seats the right half of my body sinks a lot lover than the left side making the seat very uncomfortable.
Argos sent around their "upholstery specialists" in the disguise of an agent from Home serve. Who said the seat was not faulty and the seat dipped but meet manufacturers specifications. They offered me to take out my own inspection by a firm of my choice and if they found it to be faulty they would replace refund etc.
Any advice on this anybody can give me would be a great help.. I'm just not sure what to do / where to go next with this.

You are covered by the Sale of Goods Act for up to 6 years (depending on a 'reasonable amount of time'), however one key thing that changes is the burden of proof.
During the initial 6 months of purchase the burden of proof lies within the retailer to prove there is a fault with the item, however after this initial period the burden of proof changes to the consumer (you may find it termed as 'reversal of burden of proof').
By the sound of it Argos Direct have sent out an authorised agent to take a look and they have determined it to be within acceptable wear and tear.
What the agent offered is correct, in that if you can provide a report from an accredited upholster to show that the damage is an inherent fault then Argos should be able to arrange a replacement/refund/repair.
You should, however, verify with Argos Direct that if the report finds the sofa to have an inherent fault that Argos will reimburse the cost of the report.

That's a bit harsh but probably true.
At one point about 3 years bacck I wanted one for a spare room and Argos was one of the places I looked. A lot of it is described as 'occasional furniture'.
After a family chuckle about - if it was occasionally furniture what was it the rest of the time???? We looked elsewhere as it didn't sound as though regular normal use was an option with that furniture.
Mostly with Argos furniture you don't get to inspect it until it actually arrives in your home. Another negative point imho as you can't assess the quality.0 -

oh 'triffic, i have just ordered a settee from Argos, waiting for it to be delivered, so i guess i should just expect 'tat' :-(
I did have a suite from Argos a few years back and didn't have any problems with it though, so we shall see.0
