Arresting Wages

I have a secured trust deed (as of June 2009) and Barclays Partner Finance keep contacting my house and leaving messages with my mother. I was told I am not legally obliged to call them so I haven't. I'm currently on holiday and my mother just called me to say that they called again and are threatening to call my work to arrest my wages and get the bailiffs in!

Are they allowed to do that?!

  • Do you mean 'Protected Trust deed' instead of 'secured'. If this is the case and the debt which Barclays Partner Finance are chasing was included in your PTD you should contact your PTD supervisor and inform them what is going on. If this comany does phone you, simply tell them you are in a PTD and give them the company number of your supervisor. I had hassle with some creditors after my PTD started but after a couple on months the letters and phone calls stopped once they got the message. Hope this helps.
  • sounds like there just in a collections call centre, happens all the time most of them dont know what a trust deed is or iva, but they need to stop hassling you its not fair, threre probaly om commission!

    1. They are not allowed to hassle you after you have gotten your Trust Deed up and running, you now have a new contract over-ruling all the other credit agreements about how you will repay and deal with your debt.

    2. THEY ARE NOT ALLOWED TO DISCUSS YOUR PRIVATE FINANCIAL MATTERS WITH ANYONE BUT YOU - even your own mother who changed your nappy!!! They know all about using the Data Protection Act when it suits them but suddenly the shoe is on the other foot and the DPA aint important anymore. Fire in a complaint first to them in writing and also to the Financial Obudsman... that should give them something to think about! In this case it seems your mother already knew about your situation - but what if she hadn't? Would she need the extra worry?
    Would you ask the wolves to look after the sheep?

    I contacted the people hassling my mother and they apologised and have said they have updated my file and won't contact me again. They've asked me to contact the people dealing with my Trust Deed and ask them to contact them, therefore that's what I am going to do. The phone has stopped ringing. Hallelujah!

    If someone contacted my mother & informed her of my financial affairs I would want more than an apology!
