Capital One placed a CIFAS in my credit file

  • How long do CIFAS markers stay on your credit file(s)? Do they ever drop off or is it a case of you have to contact whoever put them there in the first place to get them removed - period?

    as above #11 - they stay on for as long as the lender feels necessary but unless otherwise stated (serious fraud) they usually drop off after 13 months automatically. So check then, if not just ask the CRA to remove them and they 'should' do it or at least check with the lender. For cat 4's which is most common, these last 13 months in 99% of cases.

    I'm having a similar issue in that Call Credit refuse to send my SAR without a signature. I have refused (out of principle because there is nothing that allows them rights to ask for this) and am taking them to court - again, out of principle.

    I read your thread about that and agree 100%. It is a matter of principle. They all end up saying it is for our protection, but see how interested they are in protecting us when they make a mistake and refuse to fix it.
    Point i'm making is that although it is wrong, it is a catch 22 in that unless you serve court papers they can and will bully you around.

    I'd be sending i na firmer letter confirming that you'll be seeking legal advice unless they sort this matter within the next 7 days.

    This is what I have done now. Will see what they say and in case they fail to remove the CIFAS I will really seek legal advice.

    I have received today my Experian statutory report and while I do not have the best credit file, I am in the Electoral Roll, have my bank account, mobile phone and a mail order account, all reporting ok with no default or late payment. The only blackspot is the CIFAS marker. And recently I applied for the Vanquis and Aqua card. Vanquis said no straight away. I am yet to hear from Aqua, but guess they will say the same thing because of the CIFAS marker. Nationwide refused me for their basic bank account for this very same reason. That is when I ordered my credit file and found the nice guys at Cap One had done this.
    I would then photocopy 3 copies of the passport and take to the PO who will do it for you (they will do 3 for the same fee) but when you queue they usually just do it for free (well mine always do),...... make sure you get a few copies after you've had it certified as well as they can be used time and time again that way (within 6months)

    They simply cannot demd this proof from you, ring the ICO and FOS for their advice but they are messing you around and being libellous at the same time so a good threat could work.

    I'd be looking to threaten CIFAS to the ICO as well, kick them into gear as they can enforce the lender to remove the cifas. :beer:

    I have asked them to send me a final response letter with whatever they decide to do. I stated to them clearly that I have already sent enough id and by no means will send an original passport or driving licence.:mad:

    With this I will first write to CIFAS and see what they have to say.Then, if no success, I will contact both ICO and FOS. I have told Capital One about this, as well as the legal action threat for libel.

    I will tell you what comes out of this.:beer:

    Am I correct in thinking that a lot of credit checks are now done automatically - and if there is a CIFAS marker then the automatic credit check is not approved and referred to a manual check ?

    Given current staff cuts, banks etc. hav'nt got time to to do numerous manual credit checks so you are likely to get refused unless they take the time to do a manual credit check.

    There's the official industry line on what "should" happen, but advice to stoozers is avoid any CIFAS market like the plague to ensure you get nice easy applications with large limits.

    Fits in with what you're saying, if CIFAS means manually refer across the board and they don't have the resources to look at them properly then the "safest" thing an over-worked underwriter can do is hit the reject button.
