HSBC - "Informal Overdraft Arrangement Fees"

I have successfully claimed "old" charges against HSBC last year but still have an account with an overdraft. Unfortunately I still find myself going over this (basically because they "withdrew" the facility shortly after my claim -surprise,surprise) and reduce my facility by £100+ each month. I have a Flexi-Loan with them too so payments come out of this account which sometimes make me overdrawn. More often than not the payment is honoured but I get a £25 fee,on my statement as "Informal Overdraft Arrangement Fees".

They now make a big thing about these fees on their statements.

Can I claim back these fees or are they protected as they are already notifying me of the charge ???

Hope this makes sense (my 1st post).

    I have been trying to find something out about HSBC, but nobody really seems to know. Maybe one of you can help?

    Basically I am owed a lot in bank charges, but am currently well into my overdraft (my overdraft is more than I'm owed). If I was to put a claim in now, could they do what they did to this fella and withdraw my overdraft facility, or even close my account... and IF they did so would they do it straight away, or would they wait until they had paid back the charges. Obviously I won't get anything back for months and months because of the test case, but theoretically could they withdraw my O/D straight away??? I really need to know because if they were to do that, I would have to wait before I made a claim. Somebody please advise!!

    They won't close your account solely because you are reclaiming your charges back or take away your overdraft simply because you are reclaiming.

    Ok I appreciate that, but they can take it away if I've been mis-using the account i.e. going over my OD limit. The guy who started this thread lost his OD after a claim, and its probably fair to say the claim was a factor involved in that. What I really want to know is when would they do it, if they were to do it? Also, while I'm at it, I see you can claim back OD arrangement fees? Is this the case only when I didn't ask for an OD increase, or can that be claimed too? Basically HSBC take £25 per year to "review" your OD, can I claim that back, and can I claim back the £25 I was charged when I phoned HSBC up and asked them to increase my OD?

    Thanks Natwest, you are very helpful. Sorry for all my questions I just need to cover myself before I claim because if they ask for my OD back any time soon I'm in a very difficult position!!!

    It's a breach of the FSA Waiver so the OP should complain to the FSA Waiver monitoring team.

    Is this a business account or a personal account? On business accounts the bank can charge for either setting up and overdraft/increasing and overdraft which is yearly.

    No its a personal account. Does that mean I can claim them back?

    So should I get my claim in now and not worry about them shutting me down?
  • I think the answer is yes and they shouldn't close your account because you claim the charges back.

    Ok, I have a basic bank account (Due to previous bad credit) with direct debit facility but NO overdraft and although i have approx £1500 a month paid into the account I do go overdrawn (I am human after all).

    I've just looked at the last 12 months bank statements and have been charged around £900 in Informal Overdraft fee's!

    Can i claim this back??? If so, how would I go about it?
    Please be as detailed as possible as if your explaining it to a 4 year old
