  • Another update.... over the weekend, the management company has posted a letter to all residents about the parking tickets. Apparently they've had a number of complaints but they claim there's nothing they can do. They claim the council makde it a condition of planning permission that a permit based secure parking system was put into operation and they employed UKPC to patrol this.

    They say if any resident receives a ticket that was unfair to contact UKPC and appeal the fine. If a permit was not displayed we are to pay UKPC. They remind us that their office is unable to intervene, and that the fact we have a lease over the parking space makes no difference.

    I'm really surprised by their advice, and if they've written to everyone, it suggests it's not just me who wrote to them...

    I would check that out under Freedom of Information, if necessary, with the council. Even if the council demanded a permit based system - which I doubt - , then I bet that there is nothing saying that they had to employ UKPC or any other outfit to enforce it.

    And if no parking company was prepared to do it on a "commission from fines only" basis, would that then be added to your service charge? In fact, are some of your service charges going to UKPC's retainer already?

    Keep chasing this up and don't pay.

    The council may have made it a condition of planning, but that does not tie you into any kind of agreement with the PPC.

    Do not pay!

    May be worth dropping a note through your neighbours' doors, directing them to this (or the other) site for furtehr advice.

    Interestingly, the time of the incident is now marked down as being in the afternoon, when I was at work...

    And, of course, it's not a "fine".

  • Another update (partly so those who face the same situation can track what happens)

    This morning I got a letter from a DEbt Recovery company telling me I needed to pay them immediately and if not they may start legal action which may lead to a CCJ / Bailiffs / an attachment of earnings / my property being sold to cover the sum.

    It also says not to ignore the letter as it will only lead to legal action being taken.

    From the advice on the boards, some people say I should ignore this letter, others say I should tell them the issue is in dispute with UKPC and leave it at that - which path should I take?
  • If they had intended to take you to court they would not be saying that they MAY do this and MAY do that. It would be a stark Will and then they would do so. You are now due a final demand, a final,final demand and a final, final, final demand. They will then give up.As you can see they are a bit thick and can't see that you are not falling for their demands.
    Continue to ignore.

  • Another update for those in a similar position - last received a letter four weeks ago from them, my second legal letter (in red) telling me they'd accept a settlement of around half the figure I "owe" them. If I don't pay this they may take me to court.

    I've ignored this too and have yet to hear from them again - four letters in total so far.

    Pleading for half the amount is usually their final desperate act before giving up. I don't think you'll hear from them again.
