3rd Party Car Incorrectly Taxed - Affect Claim?

I wonder if anyone knows the answer to this...
I was unfortunately involved in an RTA, and appears will be classed as my fault (first fault in 8 years of driving). I typed in the 3rd party's car details into the DVLA website, where you can check if the car is taxed. It is, however is recorded as a different colour to what it actually is (recorded grey rather than black). I'm not trying to avoid accepting liability, but does the fact that this car is incorrectly documented affect the claim? Is it a valid tax disc or not?

DVLA only use basic colours on their database, so grey could be silver. Black could be grey. Green could be grey. blue can be green etc...

Sorry, not sure I understand that exactly. Presumably if you have an accident whilst driving an untaxed car, regardless of fault, then the liability falls on the untaxed car as it shouldnt legally have been on the road? As I said, not being difficult etc, but wasnt sure if its worth letting the insurance company know about the colour?0 -

If you, through your actions or inactions, cause damage to someone else's property, you are liable.

If you hit a car that happens to have no MOT and the accident was your fault then they can still claim off you.0

Sounds very much to me that you're trying to wriggle out of the claim. My suggestion would be to hand back your driving licence to the DVLA because if you're not mature enough to accept personal responsibility then you're not mature enough to drive.The man without a signature.0 -

they may have been going to an MOT test centre, being driven on trade plates etc etc.
but as already said, colour doesn't mean much. My BM would come up as red but it's more of a maroon, seems that BMW only work in basic colours.0 -
As others have said there are only basic colours listed with the DVLA. My car is grey but is registered with DVLA as silver. His car may be a charcoal grey that looks black. Therefore yes it is a valid tax disc and so therefore yes it is your fault still0

My suggestion would be to hand your internet connection back to your provider, because if you type messages like that, youre not mature enough to have access to the internet. Or perhaps with 3600 posts in little over 2 yrs, youve nothing better to do with your time?0 -
