Refund from Comet

I bought a Beko washing machine from Comet on the 18th July 2009 (paid in cash), it wasn't in stock so I picked it up on the 22nd July. Fitted it but didn't use it as we went on holiday.
First use was on Sunday evening 2nd August... it didn't work, it was still spinning on Monday morning. Tried spin with an empty drum but still no good.
Called Comet to arrange an engineer, who was due today but didn't arrive.
Called them back and they said it wasn't booked. I said that it was and I was told Wednesday between 8am and 6pm.
Anyway, I ended up speaking to a supervisor, who apologised and said they were in error and the visit had been unbooked.
The next available appointment for the engineer is Saturday 8th August.
At this point I'm not happy (holiday washing piled up, holiday days from work wasted, waiting for a non existent engineer etc.).
He told me that they don't compensate for losing time from work and when I asked for a refund because I needed a washing machine urgently, he said they wouldn't do that either.
I reluctantly agreed to the Saturday engineers visit.
Would I have been better taking it back to the store? (the packaging is gone)
Have I made a mistake in accepting the new engineers date?
I'm very angry over this, the machine didn't work from day 1

I'd take it back, tell them that you are rejecting the goods under the SOGA and demand your money back. The fact you have booked an engineer is of no consequence...
Whilst I appreciate things can go wrong from time to time, if something is faulty the first time you use it, I believe it is right to get a new unit, not the one you have repaired...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Beko should issue an uplift number for an exchange, it's only three weeks old. Ask Comet to obtain it for you (you'll need to give them serial number details if they don't already have them).
I don't think agreeing to the engineer's visit should change anything. I remember someone in a similar situation, and when I phoned to cancel the visit and get authority to exchange, the person on the end of the line said "I don't blame them, I'd want a new one too"Squirrel! If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
Now 20% cooler0 -

Thanks, I may get it in the car and turn up at their store counter with it!
EDIT: after putting back the transit bolts, of course!0 -
Engineer comes and it needs parts and that takes another three weeks. I would return it.

UPDATE: The engineer arrived on Saturday morning, changed a board and deemed it ok and left. Put some laundry in and lo and behold it didn't work!
Phoned Comet and told them. The guy said he'd try and get the engineer to call back, but couldn't promise same day.
I told him that I'd be taking it back to the store in the afternoon for exchange/refund anyway. He said he'd see what he could do.
Half an hour later I had a call from Comet giving me an uplift code and they would exchange the machine. Took it down myself, got the exchange without any problem, got it home, fitted it and...........................
it works a treat! :T0 -
