Faulty Car

Hi,

My daughter bought a Freelander from a dealer last Wednesday, 31st July,
When it was test driven a noise was heard coming from the rear on occasions,
the dealer thought it was probably just a worn bush and not to costly to repair so my daughter bought the car. On having it inspected by a Landrover specialist it turns out to be the IRD unit with a repair cost of £900 plus labour plus VAT. What rights does she have with the dealer in respect of returning the car for a refund or the dealer covering the cost of the repair?

The car is a 2001, 51000 miles and she paid £2300 for it.

    There should be a warranty on the car if she bought it from a dealer. If not, she'll still have rights (unlike a car purchased privately) - first thing would be for her to ring the dealer. If they're not forthcoming, ask Trading Standards for advice.

    forget the warranty for now - its over and above your statutory rights and probably not worth the paper its written on as they usually exclude many components of the vehicle.

    under the sale of goods act 1979, goods must be of satisfactory quality, free from defects and fit for purpose. Your daughter may still be able to reject the goods and claim a full refund dependant on her usage of the vehicle but failing this the trader should offer to repair the vehicle at no futher cost or provide a like for like replacement.....

    if the trader does not resolve the issue go to trading standards who will be able to conciliate on your behalf. as it is a civil dispute they would have no powers to force the trader into offering your redress but can usually achieve a satisfactory outcome.

    if that fails, go to the small claims court

    Why did she buy the car without getting it repaired by the dealer first? Part of test driving a car involves looking for faults and getting the dealer to agree to fix the problems before you commit to buying the vehicle.

    She's been lucky with the £900! Apparently in the trade they are called "Three Granders" because when things go wrong that's usually the cost to fix it!!!!
