    They had a month from the time the small claim was originally issued until the case entered judgement. plenty of time which i'm sure the court will see in my favour.

    The responsibility for this mistake is down to you.

    In the notes to claimants, the court spells out the importance of naming the defendant correctly.

    If you take further court action against the original wrongly named defendant to recover the money wasted over your error, you will be just sending more good money down the drain!

    It isn't down to a wrongly named defendant to put the claimant right. (Even if they had done so, your original summons couldn't proceed - you would still have to issue a correct summons as a brand new case, or apply to the court to change the particulars of claim, which still costs!)
