Failure to Provide Warranty as agreed

My daughter bought a car in January, with a "free warranty worth £300". When she broke down in June (250 miles from home), we realised the warranty wasn't in place.

Car dealer blamed it on warranty company but agreed to refund the repairs (£171) that she needed to get home, if the invoice was reissued in their name.

She has received no refund for repairs, no replacement warranty, no proof that the warranty was ever paid for/request by dealer.

I think this is breach of contract and she can seek £300 plus any court costs, but would like some advice on this please?

    No, she can only claim her actual losses, £171, plus costs.

  • So, if she has another breakdown within the 12 month period, she can claim for the next cost of repairs then? I thought her loss was the value of what she didn't receive ie 12 months warranty.
