    I would call them, give them a very small window for collection and ensure they do this within 7 days.
    If they do not, tell them you are going to bin it.

    After the 7 days, use it.

    A similar thing happened to us about 18 months back. My mother-in-law suffered from MND so we had carers and nurses in every hour or so during the day whilst myself and my wife had to go to work.

    One day we came home and one of the carers had accepted delivery of a Nintendo DS but there was no paperwork with it, just a box with our address on. There wasn't a return address or anything and the carer insisted that she didn't sign for anything as the delivery man just came to the door and handed her the package and got in his van and drove off. There wasn't a great deal we could do about it but we put it to one side incase a neighbour came round to see if one had been delivered by mistake.

    Anyway 3 days later we came home and there was yet another Nintendo DS exactly the same as before there was no details with it. This time a district nurse had taken delivery and said that she didn't have to sign anything either and it was just a plain white van that the item was delivered in.

    Anyway we kept them in their boxes at one side for 6 months and we still hadn't heard anything so we started to use them.

    A further 12 months has passed and we still haven't got a clue where they came from and no-one has claimed them.

    I would say that in your case if you have contacted the company and you still haven't heard anything then start to use the bed.

  • I would like to send the item back if I knew where it had come from. Since the company who manafactures and distributes it has now no record of sending it, how can I be certain it was them who sent it in the first place. I wanted confirmation from them simply because if I sent it back and was subsequently contacted by a retailer requesting money, I could state that I no longer had the bed and advise as to where it had been returned.

    I too agree there is no moral dilemma if you have notified them. If it is taking up space I'm guessing you could send them a letter by recorded delivery demanding they pick it up within a suitable time scale. I'm sure they'd be a provision in law for this.

    If you left your name and address with them, you've done your bit. It's now up to them to arrange to pick it up.

    Have you been to your neighbours with children and ask if they've been expecting anything delivered? (don't say what...)

    If lots of companies distribute this type of bed, you can't be 100% which one it comes from, and if the one you contacted had no discrepancies on their stocktake, it probably wasn't theirs!

    Actually I don't have the answer, it is better than I thought since the Consumer Protection (Distance Selling) Regulations 2000. See Here or google on "unsolicited goods"

    Legally they cannot charge for unsolicited goods. In fact, if they do so, they are committing an offence immediately under The Consumer Protection from Unfair Trading Regulations 2008 Schedule 1. This is a list of banned practices which are strictly enforced. There is no defence to these actions. There are 31 of them, and number 29 is:

    29. Demanding immediate or deferred payment for or the return or safekeeping of products supplied by the trader, but not solicited by the consumer, except where the product is a substitute supplied in accordance with regulation 19(7) of the Consumer Protection (Distance Selling) Regulations 2000 (inertia selling)

    If they attempt to bill you, you should report them to Consumer Direct immediately.

    Keep the bed, sell it, do what you want with it. It's yours to keep legally. Never mind the morality police who patrol these forums. DVardy is on the right lines, but there is no time limit, You get to keep it from day one. Enjoy!
  • Many thanks to the majority of you guys for your advice. I will keep the bed now knowing what I know.
  • Infact if they do come to collect the bed at some point you can charge them reasonable costs for storage (although you should probably inform them you are going to do this)
