lack of building regulation will it stop my sale!

In terms of your sale, you actually have a problem house. You have to explain to a buyer and his lender that there is no building regs approval and the comeback could be anything as far as the buyer and the lender are concerned. This may put the lender off, it may cause a buyer to choose not to offer on your house or to pull out when the implications are understood.
We bought a house with a dodgy conservatory years ago. We didn't find out until after the survey. It didn't matter to the lender and we just lived with the fact that it didn't have building regs. The sky didn't fall in, and nor did the conservatory.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. I would think there are hundreds of thousands of conservatories which have neither planning permission nor building regs.If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0

we wern.t told by our builders and as you can imagine i,m very angry with them but thats for another day
With the greatest respect, its your responsibility to find out if you need planning or building regs before commencing work. You can't blame the builders for your lack of research.0 -
thank you to everyone for there responces. although we have replaced the original roof with a polycarbonate one i was told by the inspector that it carn,t be classed as a conservatory because i have my kitchen in it. also we do not have doors inbetween my lounge and what is now a dinning kitchen. getting a little nervous i have to say about what may happen next. i declared on the hip that it was in the hands of the planning but they have said that to get the building regs would be to disruptive and they wouldn,t be enforcing any regulations on us. just confussed as to where i go from here as far as my buyers are concerned. i forgot to mention that the house is a terrace house and what we actually had done was to extend the kitchen all the way acros the back of the house take the original slate roof off and replace it with a reinforced polycarbonate roof that covers the whole roof0

At this point you will either need a letter stating that they will not be taking any enforcement action or to get them in, either for a certificate of regularisation - I'm dubious about this as I cannot see how any habitable room that complies with the building regulations could have a polycarbonate roof considering the amount of insualtion you have to pack into livable parts these days - or advice on how to make it comply or get it so that it doesn't need to comply.
To purchase an indemnity policy you need to have not spoken to the council about it. Unfortunately you have shot yourself in the foot there. If you are lucky, they will write on your request to say that they will not enforce.

i was gutted when i found out you couldn,t get the insurance after i talked to the council. wish someone had told me this before, hinde
site is a wonderfull thing
the polycarbonate roof isn,t what you would normally find on a conervatory it is very thick and has steel rods running through it so that you are able to walk on it as we needed to have a fire escape root from the rear of our house
i have already had a letter from the council stating that they will no be enforcing any regulations on us and have given this to my solicitor. hope ther is something can be done. i,m sure the building guy musn,t have though it unsafe or he would have taken action i,m sure?0 -
