My husband has had an MBNA card for years and we noticed they were charging him card and payment protection. I wrote to them over a year ago and pointed out they were charging him for this and that he had not agreed to it so could they repay the money back. They wrote back and enclosed a copy of their terms and conditions and said that as they would have originally sent this out with the card / statement detailing the above protection they had therefore advised us of the charges and that it would have then been down to us to cancel.......Is this correct?
Surely they shouldnt just put this charges on your account if you havent actually asked for the protection in the first place. Surely, it's not an automatic charge that you should have to ring them up to cancel or are they counting on the fact that people dont read these booklets they send out in the first place.
I didnt persue this at the time but it has really annoyed me that eventhough I wrote to them a year ago disputing this protection they have continued to charge it to my husbands card. Should they not have cancelled this once I wrote to them or should I have written a second letter then actually telling them to cancel the charges.....?!?!?

If you believe it was missold then write to them from the guide here and state your argument. You then give them 8 weeks for full and final response and if they disagree with you, then you can take this complaint to the FOS. Send everything recorded delivery and also try to keep copies should things need to go further.
