Amazon returns

I got a Creative Zen Stone Plus from them in February 2008. It broke the following April and Creative sent me another then. So now that one has broken. Creative won't fix it as it's over a year old. I want to try to return it to Amazon, but its past the 12 month mark for them too. I've heard that consumers have the right to return an item to wherever they bought it from within 6 years for repair or replacement. But what's the truth behind this. I personally feel that only having a year warranty on electronics is ridiculous as they should last a lot longer than that.

It's upto a "reasonable amount of time" to claim within the 6 years that the Sale of Goods Act offers, i.e. if you paid £3.99 for a toaster you can't go up to year 5 and say that you want it repaired or replaced, whereas with a £799 TV then you would have a claim.
Firstly your contract is with Amazon, not the manufacturer.
Secondly, you should be aware that they are within rights to ask you to get an independant report from an accredited (sp?) engineer confirming that the fault is inherent, as after the first 6 months from purchase the burden of proof changes from the retailer to the consumer.
After it has been established that it is inherent (if it is), Amazon should offer either to repair it, replace it or offer a partial refund, of which they get to choose which remedy is used.

Thanks for the information. It's a £55 player. So it's not ridiculously cheap, but not immensely expensive either. Do I have the right to request a refund/replacement for an item of this value?0

You might be able to get a partial refund - they will take into consideration how much use you have had out of it and how long you have had it and then maybe refund some money. It's worth a try!0

For those wondering. Amazon are amazing. I emailed them with the order number. And even though the product was ordered in Febraury 2008, they had no problem with sending me (on the same day) an email containing a prepaid address sticker for returning the item.
Usually they would replace it with the same one, however as they don't have any zen stones in stock, they're sending me an Amazon gift voucher worth the original order total (including postage and packaging).
So easy, buying another mp3 player off Amazon when I get that voucher.
