Got Parking Ticket even though was told by Warden it was ok to park there....

Wife is on holiday with kids in Devon, she parked on a grass verge of a car park near the beach, after checking it was ok to park there with the warden.

He said it was fine, as long as she had a valid ticket.
Which she does. Infact she has a weekly ticket.

When she returned, she got a parking fine ticket!!!
Whats that all about then??
One warden says its ok, then another one fines you !!
Sounds like a scam to me......

Have phoned them, but jobsworth woman wouldn't listen, and say it has to be in writing.
But I'm off to join the family on Wednesday, so any reply probably won't get back to me until we return home.

I have emailed them.

Any advice please?

1st ) is this a private car park or a council one?
2nd) if council copy ticket and host with tinypic, detail for posting in stickies.
    3) if private ignore all paperwork from them and file in a drawer
    4) don't contact any ppc as there is less chance of a ppc accepting an appeal than there have been drivers taken to court and the ppc winning.
    5) don't ignore a council one.

    2) If you would like someone to help/advise on the ticket, copy/photo it, and using the advice given in the stickies, add it to your post, don't forget to erase your name, address and vrm first.
    4) Had it been a private parking company do not appeal/contact them in any way despite all the threatening letters and so called solicitors/debt collectors.

Regarding the "Not Paying" bit hold back on that, unless you have it in writing from the ceo its your word against his--guess who they would believe. It will likely be suggested that you ask to get the ceo's notes to see if he made a note of the conversation--unlikely though. Unless you have a good reason why the ticket is invalid and the adjudicator agrees its possible you Will have to pay, but thats quite a way down the line.

Oh, dear.. this is what happens when everyone trying to enforce the law isn't singing from the same song sheet. Although one warden was happy to relax a rule (which they aren't allowed to do), his colleague stuck to the rule book.

There isn't a lot you can do, except learn from the incident. Always acknowledge anything in writing (official car park signs) over word of mouth. In fact, don't even ask a warden anything verbally, as his response will make absolutely no difference to the word of law. Just check the sign yourself. If the sign says you can't do it, don't. Most council car parks prohibit parking outside a marked bay and the signs do say this.

If you do believe that you weren't doing anything wrong in parking on the grass verge, then take a picture of the sign and go inspect a copy of the council's "Parking Places Order" for that car park at their offices. This, and only this, may reveal any loopholes or grounds for appeal.
  • wahey, its taken a month, but just got confirmation they have cancelled the ticket !! :D:j:rotfl:
