IVA and pregnancy

Hi all,

I hope someone may be able to help me. I am in an IVA at the moment and have just found out that I am pregnant. What does this mean for my IVA? Will I have to fail it as I will be going on maternity leave? I will be able to return to work full time after maternity leave and hopefully have minimal childcare costs as family will help, but money will be short during maternity leave, which means I won't be able to maintain the IVA payments as they are now, but would need to reduce them.

This does NOT mean your IVA will fail.

The first thing you must do is contact your IP and explain that there will be a change to your situation. (They will congratulate you - congratulations BTW - and wish you all the best).

The next thing they will do is have a look at how this change will affect your IVA. Obviously your I&E will change and your supervisors will need to find a way of putting forward a VARIATION for you. Provided the variation can achaive a similar sort of dividend for your creditors - and this may involve extending your proposal by a number of months - then there would hopefully be no need to fail your IVA...

(An IP would have a duty to fail the IVA if you continually missed payments so it's important to discuss this with them before the event!)
