Parking Penalty from private parking company

Advice please.

I parked in a retail car park which is monitored by a private car park company, you get 90 mins free but have to take a ticket and display and you have to only use the shops in the retail park.

I displayed my free 90 mins parking ticket but when I returned to my car 40 minutes later I had a parking notice for £100 reducing to £70 if paid within 7 days. When I opened my car door my ticket was on the floor, I can only guess that when I shut the door, as it was quite windy, a gust of wind blew it onto the floor.

I have my parking ticket and two receipts for the shops I visited in the retail park. Where do I stand legally on this?

Should I write and appeal or should I ignore it as many people seem to advise? Does anyone know if it went to court what would my chances of winning be?

Thanks.

Don't write to 'appeal' as it's a waste of time, I am yet to see a genuine example of someone writing to a PPC to successfully 'appeal'.

If this went to court you would be able to prove, by producing your parking permit/ticket, that they have suffered no loss. Under contract law they can only claim for actual losses, not a figure plucked out of thin air.

Trespass law wouldn't apply here as you were invited onto the land and thus obtained a ticket/permit. However the chances of them taking it to court are minuscule as they make their money from intimidation and threats which are endorsed by the DVLA which makes millions in profit from this scam alone.
