Personal Account & unauthorised o'drafts - whats the difference>?

Wonder if anyone can help me
Wrote to my bank re unauthorised overdraft charges - asking for my money back (using the fab template on this website).
Have just received 2 letters back from Barclays - and am confused.
First one acknowledges my letter and says as martin advises that due to the test case all such letters are now in a queue. Fine :-)

However - the 2nd letter says the charges that have been applied to my personal current account - are legal and they wont give me my money back? Saying that they introduced new account terms and conditions in 2008(they call it a reserve usage fee - the charge for which is £22 for each working day you make use of this reserve.) Kindly however they say they dont charge you a fee for setting up or using your overdraft LOL!?
Can anyone explain what the difference is - why they say this is lawful but the other stuff isnt?

    Might be worth you asking the question: Has either charge been tested in a court of law?
    I have not worked for NatWest Bank since February 2009

    have been googling this like crazy thisam. seems this is barclays new way of getting round the high court case?
    Am trying to gather all information to write back (apparently i have 8 weeks to do so until they deem my case closed).
    I am sorry to ask - and yes i am blonde! :-) why asking has either charge been tested in a court of law would be effective?
    The more ammunition i have the better

    A bit more caffeine in me I will explain what you may have to do. From most of the info on the forums they are looking at charges up to August 2008 which is from the time their new terms and conditions came out. This means that the charges have not been tested in court but furthermore they are not looking at Financial hardship claims on the reserve useage fees. I would ask Barclays to remove the personal reserve from your account to avoid the £22.00 charges.
