New and sealed question?

hi, i have sold a phone on ebay that was new and sealed. the buyer has said there is a problem with it. do i have to refund him? because they would have broke the seal and the item would not be in its origional condition (new and sealed)
i have noted the imei number

If they go through paypal and put an item not as described claim in. They will be told to return it for a refund so yes you will have to refund. They would have to break the seal to use it. So thats a very silly argument you put across to not refund them. If they were just wanting to refund because they had changed there mind that would be another thing, How could they find out if there was a problem with out breaking the seal?0

was just asking because if/when i receive it back and it might become obvious there was nothing wrong with it i will not be able to sell it again as new and sealed0 -

it could be that the phone is broken, i had an upgrade from orange last year and the keypads wouldnt push in, that was a brand new and sealed phone.
if it was ungrade you can get a replacememnt from the phone company,. i just rang oramge told them and they collected delivering a replacement at the same time.0 -
