Is my employer liable for charges I received as a result of unpaid wages?

My employer has recently changed from paying me fortnightly to paying me monthly, wouldn't be a problem except that he decided to inform the office on the day that we were due to be payed, friday two weeks ago. Worse still I wasn't in on that day, so wasn't able to ask for a cash advance until the next monday, which I didn't receive until tuesday.

On that monday my phone bill was due to be withdrawn, but as my wages weren't there to meet it I went over my agreed overdraft limit. As a result I have been slapped with a 30 quid charge to come out sometime in the coming month. Phoned my bank and they say since it was my employers fault that I should be able to claim my money back off him. Are they right?

    The answer is that if I worked for the bank I would say the same thing and the employer may or may not agree. Ask your employer and if they say no then update your thread.

  • Suppose I'll have to give it a go. Anyone with experience of this sort of thing know if I have a legal right to a refund, or am I just banking on the kindness of my boss?
