Phone Harassment from RMA Collections

RMA (Risk Management Alternatives) are a collections company used by MBNA - they are rude, unhelpful and harass you! :mad:
I am currently two weeks behind with a payment and i am reluctant to send it as i am claiming back £2063.20 in charges. RMA have said they know of no dispute on the account.
Does anyone know what is classed as harrasment and what can be done about it? It is affecting my mental health!
I have complained to MBNA and RMA via letters.
Examples of some calls i have logged -
On 17th July 2009 I received the following missed calls: Call 1 – 11:53, Call 2 – 11:54, Call 3 – 16:03, Call 4 – 16:04, Call 5 – 16:18, Call 6 – 16:19
On 21st July 2009 I received the following missed calls: Call 1 – 12:02, Call 2 – 12:02, Call 3 – 13:51, Call 4 – 13:52, Call 5 – 13:56, Call 6 – 13:57
Today has just reached a new level of harassment which despite my previous letters the calls have been as follows: Call 1 – 12:15, Call 2 – 12:16, Call 3 – 13:14, Call 4 – 13:15, Call 5 – 13:17, Call 6 – 13:18, Call 7 – 15:40, Call 8 – 15:41, Call 9 – 16:56, Call 10 – 16:57, Call 11 – 16:59, Call 12 – 17:00 :mad::mad::mad::mad:

I don't have major debt problems - I said in my post i was reluctant to pay my months payment but i have sent a cheque in yesterdays post.
I just want to know the law on phone harassment! Can i get them for it? In the USA there are laws on the number of and frequency of calls.- The OFT warned 13 companies in 2008 about their debt collection practices which included “contacting debtors at unreasonable times and intervals” – This activity is clearly stated as unfair practice in the OFT Debt Collection Guidance (July 2003 (December 2006 update) Section 2.6 Physical/psychological harassment.
- The OFT Debt Collection Guidance (July 2003 (December 2006 update) also states in Section 2.2 Examles of unfair practice: “those contacting debtors not making clear who they are, who they work for, what their role is, what the purpose of the contact is”, “contacting debtors at unreasonable times” and “ignoring or disregarding debtors' legitimate wishes in respect of when and where to contact them, for example, shift workers who ask not to be telephoned during certain times of the day”
- The OFT Debt Collection Guidance (July 2003 (December 2006 update) “is intended to set out the type of behaviour the OFT considers to fall within the category of unfair business practices which will call into question fitness to retain or be given a licence. It is expected that applicants and licence holders will abide by the spirit as well as the letter of this guidance. Publication of this guidance will also enable the OFT to take speedier action against behaviour that clearly falls into the type of categories of unfair practices shown.”
The Citizens Advice Bureau advised:
41: Harassment of debtors is a criminal offence in England and Wales under Section 40 of the Administration of Justice Act 1970 and in Northern Ireland under the Judgement Enforcements (NI) Order 1981. This legislation states that:-
‘A person commits an offence if, with the object of coercing another person to pay money claimed from another as a debt due under a contract, he:-
(a) harasses the other with demands for payment which, in respect of their frequency of; the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation; (England & Wales only)
Does the above give any grounds for compensation?0 -
Just speak to them on the phone instead of ignoring it, and ask them not to call again and only communicate in writing.
Problem solved.

You speak to them and then 10 mins later they call again! Already communicating in writing which they seem to ignore! Obviously not that simple - sorry.0 -
All debt harassment companies are like that otherwise there wouldn't be a point to them.
BTW if you do a internet search for Risk Management Alternatives you can easily find lots of information about how they harass people, and how to deal with them.I'm not cynical I'm realistic

Switch off your phone during office calling hours or change your number.0 -

Ah, I apologise! If they arent playing by the rules, my solution is obviously not going to work. Why do these people have to be such idiots!0
