Have you complained to the Financial Ombudsman? News of the World article

The News of the World is doing a story on complaints to the Financial Ombudsman.

The journalist is looking to interview people who’ve complained to the ombudsman about any of the following three areas: payment protection insurance (PPI), bank charges and credit card charges.

    Just spoken to the NOTW guy about this matter as i have a complaint in at the moment (PPI) but must admit my complaint is not the easiest of all. He is looking for anyone that has complaints in at the Ombudsman (or has had!!) and against any of the banks would be ideal. He is wanting to do a piece on "reclaiming" of any sorts be it credit cards, bank charges or PPI. I know he would want you in the papers and a mug shot done:eek: but i think by the sounds of it, it would help with your complaint so get PM'ing MSE Jenny. You may get your story in the paper and also your complaint bought to a close all the sooner hopefully.:cool:

    Unfortunately, I have not got one single charge to reclaim so, marshallka(the jungle drums from the PPI forum tell me you are pretty good on that side of things). I hope to see the face behind the username(and if you are in the NOTW then make sure you post a link here ;) ).

    Guys any publicity about reclaiming is good publicity so please take the opportunity to tell your story if you feel confident to do so and help get more people reclaiming what is rightfully theirs.

    Hiya natwestmember, I would love to get mine in the paper but its an awkward one really, started in April last year in that i have not given up on it after being thrown out a few times with "jurisdiction" issues. I was sold my PPI (apparently!!) through a broker and the broker is outside the UK. That is a definate "no, no".

    I then complained about the rebate we received on settling the loan early (FSA said here http://www.fsa.gov.uk/pages/Doing/Regulated/consumer/tackle/ppi.shtml) as ours was an extra £4000 which was included in the settlement figure as we had PPI. I thought this would be something they would at least be able to get us a fair refund of maybe a pro rata one of about 78% (Like FP seem to offer now) of the unused PPI (with or without interest) but would have been in the least £1500 being not taking the interest in account. Again this was thrown out as they said that it was not within their jursidiction although I thought FIrstplus were members of the GISC when my rebate took place being 2003 and this would have been an "Insurance" complaint. The Ombudsman ask for a date of that the incident took place.:confused:

    I then put this forward again as Barclays trading as FIrstplus as FIrstplus were owned by Barclays (bank jurisdiction), again thrown out as they were not appointed reps but this time I asked a manager to explain things:confused:. It was then determined that the rebates of insurance are actually complaints against the insurer and should come under compulsory jurisdiction and come under UTCCR I think. This time I though we would get somewhere as the Ombudsman wrote on our behalf but then just a couple of weeks ago (after the complaint being with them since September and us getting our final response December so passed for them to deal with against the insurer) I got told it was most probably not going to win. Next i get told by the Ombudsman they needed to see what relationships these insurers had with the brokers (not just my complaint but lots of others like this:confused:) and to see if they could be classed as "agents". From what i have googled if my broker was actually a "broker" and not an "agent" then my complaint for the rebate would be against the broker cause it was the brokers job to explain the rebate method (being rule of 78). If they were in fact an "agent" of the insurer then the insurer could be held responsible for what the agent does. I told you it was complicated but i am now 15 months down the line and will not give up on this. Just have to hope i get good news in the next day or two. I can still but hope.
