Hi all,
Am new posting on here but needed a bit of advice.
I am going to reclaim my charges from Abbey. So 1st step was to send the first letter asking for a list of all bank charges sine 2001 until now. I also enclosed the £10 cheque to cover the cost of this.
Yesterday they sent me statements from Jan 2007 until present day. This is not the full amount I asked for or expected.
So where do I stand in getting the rest of the statements I require. Have read some other threads where this has also happened and the bank say records that far back are not kept. So before I send any more letters demanding these statements can you tell me where I stand on this matter, are they legally obliged to with hold these or are they trying to get out of it.
I will be writing to them as I do not trust phonecalls from past experience. I like things in writing, recorded delivery so there are no excuses!!
Many thanks for any advice.

Abbey are a strange bunch and certainly deserve to be nicknamed 'shabby'
Like you I requested statements going back to 2001. About a month later I received a large A4 envelope containing a whole load of statements on there own. The dates however did not cover the full period. !!!
About a week after this I then receive a letter from Abbey with a computerised table detailing all my charges that had been applied for the periods which the statement did not cover.
A week after this I then receive a letter from somebody in their Complaint team telling me that they had received my compliant and that the statements I had requested will be despatched shortly along with copies of my charges.
Errrrrrrrr hello Abbey, you've already sent this !!!
So hold for a bit, they may be on there way to you.
Keep us posted. If you see a penny, pick it up, all day long you'll have good luck !!!!!!

Abbey are just a pain. When you get statements from abbey you get the ones that are currently on file. The others that you will get are like photocopies from previous years. They get them off a thing called micro fiche (fish). Because they are over 18 mths old, they do keep them but in like a big filing place. So they have to go and dig them all out. it took me 2 months to get all of mine and then i had one missing. If you havent got them in 2 weeks you are best writing to them to get a move on. Theres no point ringing cos nobody will know what your on a bout cos they all indian.0

The FSA wrote to all banks involved in the test case - March 2009 reminding them of their responsibilites, regarding, retaining of information ie. statements etc. They MUSt keep statements on file, dating back to July 2001 - 6 years prior to the commencement of the Test Case in July 2007. Natweststaffmember, knows what section/paragraph the ruling was included under, in the FSA guidelines.
You can also contact the Info. Commissioners Office and tell them Shabby failed to send you a SAR dating back to July 2001.0 -
Thanks guys, will hold out till a week monday then write to them, recorded delivery!
I rang them on friday as they were about to charge me £105 for some debits that had bounced in june. No help at all. My partner is unemployed at the mo so living on benefits. Every month they charge me I end up short for the rest of the month to pay debits and then get charged again, like a never ending circle. But they just don't care. Robbing gits 8(
Will see if I get anything else turn up and then go in all guns blazing!!0
