Car Park collision - very worried

Wasn't sure if this should go in motoring or insurance so posted in both.
My OH just had a collision in a car park.
He was reversing out of a space and the road was clear so he ket going. Another car appeared behind him out of nowehere and he went into the side of it with the rear end of his car. It was a shock as the speed limit is 10mph so there is no way there should have been anything there.
I imagine that for insurance purposes he will be to blame but I just want to check this. This is a nightmare as it's a new car and a brand new insurance company with the price based on 2 years NCD.
We are very worried. What is likely to happen as we've never had a collision before (either of us)? The other car was a courtesy car as the guy had just recently been in another crash and his car was in for repairs. The damage to his car is to both nearside doors and the nearside panel.
Thanks for any help, advise etc.

If I were you I would get straight onto a solicitor because it sounds like you could be in a lot of trouble. When reversing fault will always lie with the driver because reversing is considered to be dangerous. In this instance there could be county court actions for dangerous manoevure.
Given that the TP was in a hire vehicle this could be costly for you. You will be liable for the repairs to that vehicle as well as compensate the driver for his inconvenience (having to get a 2nd replacement vehicle, his train fare to the garage, his sandwich for lunch, his drink for lunch).
If you contact a solicitor they could advise you more.0 -
You should contact your insurer and give them the details of the incident. From what you say, liability will be disputed by the third party, so let the insurers sort it out.
If you don't have any damage to your own car to claim for, then you will have no excess to pay, should your insurers accept any liability for the third party's damage. But if you claim for damage to your own car and are held liable (or partly liable), then you will have your excess to pay.
If any claim is considered by the insurers to be your fault (or part fault) you will usually lose 2 years NCD at renewal (and get none added for this year).
Try not to worry. No-one was hurt by the sound of it! It's only metal and money.0 -
Ignore #2. He's a troll. You don't need a solicitor when your insurance company will take care of everything.0

Insurance will cover it to a point. Do you have the additional legal insurance should they go to town on it?
Also - one should always reverse into a space, it's less dangerous and easy to pull out. sure a little trickier in loading the weekly shop though. supermarket carparks are rife with people making claims by putting them in a position to cause an accident such as this, not saying that occurred here of course.0 -
Hi all,
Thanks for all the help and advice.
#2 - I know we said we hadn't been in an accident before but i'm not that dim!!
#5 - the accident was in the work car park - shared with the body work garage that was dealing with the other guys car. As soon as it happened, the body work shop (they do porsches, ferrari's etc :-( ) saw what happened they rushed out with cameras to photograph the damage. They even asked OH if he wanted a quote for his car (hardly any damage at all)!! We have legal cover as part of the insurance.
I guess we'll just inform the insurance company and see what happens.
The worst part is we've only had the car 2 days, and this is how long we've been wit the new insurance company. They're going to think we're taking the Michael.0 -

I am sorry, I know I shouldn't laugh, but that's fantastic and I would love to hear a recording of your call to make the claim. :T
