new here not sure where this should go
after Travel City Direct went down last year we put in a claim with ATOL
there were 3 of us travelling bulk of payment was on my DC then one payment of £50 on another DC and another payment £160 on a CC card Total Holiday was £3800
after months they said claim should be with CC comp then they came back and said they were going to seek advice through ATOLs barristers and came back again to say we could make the claim with ATOL (are you bored yet)
the claim has been back and forward still ongoing have sent all documents they asked for but now Today (30th July) they are asking for Original Documents as the ones sent were photocopies, i am so frustrated with ATOL why didnt they ask for the Originals 10 months ago
not sure where i go now

    Ok, Travel City Direct was part of the XL group collapse.

    Have you had the below form from ATOL?

    You have until Sept 11th 2009 to put in your claim.

    However, as you have stated that over £100 was paid on a credit card your claim will likely be declined by ATOL/CAA.

    The responsibilty lies with your credit card company to repay you the whole amount including any other payment methods.

    Advised in section 2

    "
    2) Refunds for advance payments made directly to The Really Great Holiday
    Company using a combination of payment methods including credit card
    For holidays costing between £100 and £30,000, where any portion of your holiday
    payment, irrespective of the actual amount, was made directly to The Really Great Holiday
    Company by a credit card, the CAA will not refund the credit card holder for any payments
    he/she made to The Really Great Holiday Company. The relevant credit card issuer is
    responsible for reimbursing all payments made by the credit card holder, including
    payments made by other means (cheque, cash, debit card, chargecard, etc). Card holders
    should contact their credit card issuer for a refund of the entire amount they personally
    paid to The Really Great Holiday Company under Section 75 of the Consumer Credit Act
    1974. Card holders will need to forward this letter to their card issuer to assist with their
    claim. Please note we can only provide this form of the letter and we cannot address this
    letter to specific individuals."
