Bit of help with MBNA please?

My sister is in some financial trouble, but thanks to this website has contacted CCCS and is slowly sorting herself out.
She had an Alliance and Leicester card with MBNA and has been making token payments. They have pestered and harrassed her via home phone, mobile phone and email. A letter went off on the 17th July recorded delivery demanding these forms of contact stop and was signed for on 20th July.
Now, she recieved 3 emails yesterday within a 20 minutes period offering a 'special offer'. She replied explaining that she will not deal with them this way and that they knew this via letter.
A reply came back today (via email ) saying this:
We have received your letter only yesterday the 28th. We have sent you emails as you have requested to deal in written correspondence.

Apologies for the emails. We do not wish to harass you just get this sorted

If you are happy to deal with this via email reply and state this and I will send you some options to help you
She also received another text, this time offering upto a 60% reduction in her bill... is it worth her asking for a CCA? I asked her when she took out this card, and she said over the phone 2 1/2 years ago.
Any advice on how to tell them (politely) to stop harrassing her?
Cheers guys,
Stunty.

Oh.......This is a very interesting (and worrying) development..it appears that the standard harassment letter requesting only letter contact is now being interpreted as emails count the same as letters.
We will drop a PM to Fermi to have a butchers at this before going any further on the advice front...as it seems they are trying new tactics and everyone (ie including debt counselling agencies) needs to be aware of this.
For what it's worth..I think you should send the harassment letter again(amended to your circumstances) requesting all email/text message/electonic forms of communication correspondence stop forthwith...and only letters BY ROYAL MAIL POSTAL DELIVERY will be accepted.........and saying if this is breached any further you will report them to "the relevant authorities" (ie OFT and others... but we need to determine that) for harasment
Sorry, bit on the hop tonight.... will think about this overnight and maybe have a fuller response for you tomorrow..
Stay strong....

You could ask for a SAR, detailing all their doings with her.Oh and report it to their complaints dept too. I am just about to do this with Mr.B and Crapital one. Funnily enough MBNA have been ok with him and Capital One are behaving exactly the same to him as to your sister.
Is there any chance though that she could make an arrangement to pay the 60% as a full and final? Sometimes they will do this over a period of time?Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

Cheers for the reply Wol2, I've checked and my sis states that the letter she sent stated that she would not accept communication via phone call OR email, she's sending me a copy to check for you. I agree, it's a bit worrying!I am one of the 63336.'It is better to have lived one day as a tiger than a thousand years as a sheep.'

Just had another thought, you can ask them to remove telephone numbers off their system and insist that correspondence is to a stated address too.Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

Sadly, no, she cant raise the cash, and I can't lend it her either, or I would. At least MBNA have been ok with someone!I am one of the 63336.'It is better to have lived one day as a tiger than a thousand years as a sheep.'

Swings and roundabouts with them isn't it? After watching the dispatches show about DCA's and the way that debt is collected i have no compunctions about dealing with them in the same vein back.
Sorry about her situation though, and its a shame about raising the cash.Blackadder: Am I jumping the gun, Baldrick, or are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?
