ebay woes!! advice please

hi all im after some advice.
i purchased a tuning box off a seller on ebay for my car.
first of all he sent the wrong wiring loom with it.
so fair play to him he sent another loom which was supposed to fit but didnt.
so i contacted him to return the tuning box as i couldnt be arsed with the hassle of cutting my loom.
i packed it up and sent it to him and he received it today however i have just had this email off him now.....

My colleague received the tuning box this afternoon (Im not in office today) along with the additional loom thankyou.
Im concerned to the reported condition of the unit i.e. scratches etc. considering it has'nt been fitted?
Can you let me know me how this occured?
I will be in office tommorow to take a look and to process your refund.

now as i didnt have the correct loom it was never fitted to my car and therefore never scratched.
there were 2 marks on the back of the box when it arrived , i didnt really think about themas the looked superficial and i thought they were the reason it was so cheap.
do you think im going to have problems getting a full refund out of this bloke or not??
