Dear Martin - PLEASE PLEASE HELP!!!!
The company i work for went into administration on 15th JUly 2009 and from the 1st April 2009 this year we were asked by our company if we would agree to short time on a temporary measure (4 day week instead of 5). We were told it would not affect our salary and we would be paid redundancy if it happened on our normal salary not on a 4 day week.
We have been told today that the administrators have received information from the RPO that they will only pay redundancy based on the last 12 weeks of earnings which obviously since 1st April is on short time.
We just feel its criminal - i have worked for the same place for 24 years and they say they are going to pay me 21.5 weeks redundancy at my short time rate and we were told it was only a temporary measure....i am utterly disgusted...- anyone out there who could confirm this is correct - or Martin please help....as we have not been told a date yet - but we have been asked if we would be willing to travel to work at the head office which is an unreasonable mileage away from where we work now, so i and many others have said no - so we feel we will be made redundant very very shortly - but want to get some facts together....but don't think we have a leg to stand on as the RPO have agreed with the administrators that it is the 4 day we get paid redundancy on and not the 5 day

Sorry me again Martin - hopefully this is getting to you....
Regarding going into administration....i did phone ACAS last week explained the situation about short time and redundancy looming as we were in administration and one of the advisors said that it would be on our full normal salary as it was only temporary the short time, yet another advisor today has said it would be on the short time pay....JUST NEED TO KNOW, SO I CAN LET EVERYBODY ELSE KNOW (17 OF US )

You need to look at the agreement that was reached with the employer when you were asked to do short time working. Did you have a letter spelling out what was happening, and have you told ACAS about the contents of the letter? If not you need to do so.0
