Hardship?

My oh and I have been trying to recalim our bank charges since we discovered the saint that is Martin Lewis.
Last year we got copies of our charges for the past 6 years and sent off seperate letters to Lloyds TSB (Claiming £2500 and £3500 seperately). No surprises but it was sent back with the whole test case/on hold excuse.
OH is a student and has been for past 3 years so we both wrote again asking that at least if they wouldn't pay us the money back they would put a hold on our charges as he was a student and I was supporting him.
Nothing
We then, following advice from on here, pursued the hardship clause. I kind of thought I wouldn't have a chance but at least my oh would since he is a student. They have still hard balled us and said that they won't pay back anything until the test case is heard.
Just wondering if anyone has any advice on proving the hardship (other than still attracting overdraught fees since we struggle every month). It's just really frustrating when you go £5 over for 2 days, know it's going to happen reeuqest an overdraught extension for £10 to cover it for 1 month and have it refused then are expected to pay approx £50 for the 2 days you were overdrawn!!
Any advice will be gratefully received Thanks

I have electricity arrears due to their not telling me they supplied me and mepaying someone else. amounts to about £900 I think. I owe the nursery about £500 for my daughter's care.
I got out of a trust deed 2 years ago so have no other debts to speak of.
HIs nibs has debts to lloyds tsb and barclaycard credit cards amounting £5500 he'd see them as a priority but I guess not the kind they would see as priority. He also has about 6-9 months left on a loan with lloyds.0 -

Did you get the money back from that supplier then?
On a basic reading of the details the bank are likely to say no. Nursery fees would not be priority debts and the credit card reclaiming would be easier providing they were not part of the trust deed(similar to bankruptcy in England and Wales, right?)0 -
Should at some point but your guess is as good as mine as to when. I thought it would just be a case of oh is student down to one salary to live on. Didn't think that having come out of the trust deed (yes a scottish IVA) would have a negative effect since it left me hypothetically debt free.0
