Post IVA clean up

Options
I am really confused about how to go about cleaning up my credit file after finishing a full and final IVA in 2007. I have just got hold of my Equifax file and some accounts are shown as partially settled but there are not default dates on them. Am i right in thinking that the default date has to go on in order for me to have some sort of chance of getting credit in the future! Does that make sense??

    HI Spider

Equifax is very confusing as far as defaults go, I have just finished getting all my defaults dates corrected with Experian and Equifax after IVA F&F as well.

All accounts need to be shown as settled or partialy settled but on Equifax instead of showing as defaulted I think it shows as Delinquent date.

The delinquesnt date or date settled whichever is teh latest is the one that the debt takes 6 years to drop off form, if this date is before you entered your IVA you need to get the original company to change it

  • Thanks very much for the reply. When my husband and i went into the IVA we had a overdraft with Abbey which i thought was incorporated into the IVA. Today i have had a letter from them saying that they sold the the debt onto another company! Can anyone help with this?? What should i do and can they still get the money back from me? I thought all the problems were over but looks like its coming back to haunt me

You need to check your original paperwork for IVA and make sure this account was included. Throughout my IVA I got odd letters form companies saying the debt had been passed on to other companies, these letters were only for reference perposes and does not effect the IVA.

I thought IVA's coupld not be joint ones (I could be wrong), so when you say both yourself and hisband entered into an IVA, did you do seperate ones?

If just one of you did the IVA, the Abbey will chase the other partner for the overdraft (even if it was included in the agreement) as all parties are joint and severably liable for the debt

Seems though they are naughty waiting until after you have finished the IVA to then chase for the money

A couple of telephone calls should sort this matter out - tell Abbey to get their act together and also advise your IVA Supervisor. This is totally unacceptable.

If they continue to act like baboons take the matter to the financial ombudsman.

having been on that site it does seem rather favourable with regards certain companies to say the least and some of the advice is a little questionable....
