2 years ago a man knocked on my door telling me that baliffs would be instructed unless I made a repayment plan for an Egg card at £50 per week and he was going to come to the door to colllect the money weekly. Suffice to say that it was a credit card debt from 4 years previously which I now understand would have been statute barred as I live in Scotland. I had moved twice in that time so I guess letters went astray but certainly I had not received anything from Moorcroft saying that they had taken over a debt from Egg.

I sent a direct debit up with the man agreeing as I absolutely did not want to be hounded by people coming to my door weekly (and he did not appear too friendly!!).

I recently changed bank and the direct debit got cancelled in the transit - I had in face forgotten it existed.

I now have a letter from moorcroft telling me that as I "defaulted" on the credit agreement that a collections person will be attending my premises.

The first question is :- is it too late to ask for a credit agreementor dispute the debt. This is not becuase I am trying to dodge money owed but rather becuase ther appears to be a huge amount of fees added to the original account.

Next is what are the circumstances around Moorcroft coming to my door like this. My neighbour also said she received a call yesterday to pass on to me that they were trying to contact me about arrears. (This is becuase I have an ex dir number and she refused to give it to them).

    Never...ever open the door to them or speak to them. They are simply not allowed to do that and there are some thread around you can send to moorcroft. I would suggest that you send a request of CCA to moorcroft regarding that account and see what they come up with. As far as an account been statute barred, I believe it is after 5 years in scotland or 6 years for the rest of us if no payment has been paid towards the debt or you have not aknowledge the debt. But you will find more detailed information on the "debt Free" forum

    Absolutely - I was really stupid!!! I guess I just want to know if it is worth fighting or if now that I started - I should just finish the payments.

    It has to be your own decision but personally I would fight it and give them a bit of a hard time and at the same time it will give you a bit of breathing space. On the "debt free wannabe" forum you should find plenty of template letter you can send to moorcroft regarding their visit to your home or trying to contact you but as well sample letters to CCA them. You can also look at some site like "nationaldebtline" where you will find an array of template letters

    Well - Update is that I sent the letter recorded delivery to Moorcroft asking for a signed credit agreement. I heard nothing so chased it again. yesterday I came home to 57 missed calls on my home phone and 38 on my mobile with 4 texts and 5 voicemails!! These were all from a company called ARC Europe. This morning at 8am they called again and confirmed that they had been referred the debt by Moorcroft for the Egg agreement taken out in Jan 2004.

    I explained that I had asked for the agreement and that Moorcroft had cashed my cheque. Arc said that they would send it.

    What happens now as I appear to be starting from scratch?:confused:

    Thanks! Certainly - I think 47 calls is a tad harassing! I guess that is all part of the " fantastic predictive dialler" they rave about on their website.

    I'd be sending them a very sharpish reminder of their breaches and mention continued harassment will be reported to OFcom as well......

    LOL so much for them sending a credit agreement - today they called at 7am and threatened solicitors and court!!! I asked that they deal in writing only until I have a copy of the agreement. THey now say I have to send them a cheque and formal request. I pointed out that I had sent this to Moorcroft and Moorcroft had cashed it. However - I will now send it to them anyway....
