Starting Claims With HSBC & Natwest

Hope that you are all ok.

I have a couple of questions that I have actually spent an hour writing about on here - only for my laptop to crash and lose everything that I had typed - like a pillock I hadn't copied & pasted it from something else. Nevermind - I will start again but abbreviate it this time.

In 2005 I got myself into quite a mess - I didn't have any income from January to July. I had a Natwest Current account & Credit Card and also had a personal loan with them. I owed (approximate figures) £10,000 on the loan to Natwest, and £4,000 on the credit card. Natwest put the credit card to Triton Credit Services to collect and I ended up settling both accounts in the July '05 when I sold some of my shares (i had to wait until July to sell them - couldn't do it before) I also cleared all of the money that I owed anywhere else at the same time.

How do I identify the charges from the loan - as I don't have any record of these? Do I make a data protection request or what?

I am keen to establish if I can reclaim the charges that I was hit with relating to the credit card (and by Triton) as I have been reading here that due to my lack of income from January '05 to July '05 I may well be able to get something back and that the credit card charges are certainly deemed to be unfair (separate to bank account charges)

I am also separately claiming any charges that HSBC have hit me with since June '05. I changed away from Natwest when I paid them off, as I had business accounts with HSBC & liked the convenience of having everything in one place with one manager of my affairs. I don't owe them anything personally (as of May 09), but my business account regularly is into the £3000 overdraft that I have with them. If I claim are they likely to start calling in other debts such as my business overdraft?

Due to the irregularity of my income (and my poor money management) I have been walloped with charges quite a lot. I have paid everything that I owe to anyone over recent months and want to get back on track on a more permanent basis - however with HSBC smashing me for money here there and everywhere it has been rather hard. Am I likely to see anything back from them as the threads on here seem to suggest that they have everything on hold until the test case is settled?

I do keep all of my paperwork now - and have everything since June 2005 filed and completed. Things before then are less available, but I do have things like the old card numbers and things that I can make data requests for.

I am planning on leaving to travel the world in October, so want to get all these things underway before I leave.

  • You can claim back credit card charges and they will pay immediately since they are not subject to the OFT test case issues. From my reading of your post, I cannot see the bank looking at your case as financial hardship one but definitely get your claim into the bank which will be acknowledged. They can't or rather shouldn't recall your overdraft on the business account because you reclaim on the personal account.
