Where do we go now?

I posted on here a while back on behalf of my sister who was badly assaulted at work and has been really poorly since. She is on sick leave at the moment so is not on full pay and due to her state of mind, let some of her debts slip.

Myself and mum are in the process of trying to help her. After reading posts on here, myself and my mum have sent letters offering full and final settlements to try and get the matter sorted for her ....... creditors not interested. We then thought, we could set up monthly payments for her and pay them until she is in a position to go back to work, whether it is in her current post as a nurse or otherwise. Hit another brick wall, because creditors are refusing the amounts that we have been offering :mad:.

We're totally at a loss as to where we go from here. All creditors are fully aware of the situation and the problems that my sister has had recently but they don't seem bothered ....... HELP! x

    For general advice speak to one of the debt charities http://www.moneysavingexpert.com/loans/debt-help-plan#help

    However, in the situation, I suggest a strongly worded letter to the creditors would be in order. I suspect that some muppet thinks that because you are helping out, they can get you to pay her debts, even if this is forbidden under OFT Guidelines.

    Will post another thread link here in a mo.

    If that does not work , formal complaints to the OFT and trading Standards are in order.

    Are the monthly payments you have offered calculated according to a complete Statement of Affairs? If not, then you need to complete one. Sticky at the top of this board. If so, then whether the creditors like it or not, if your sister ain't got it then the creditors can't have it.

    I've not sent them a Statement of Affairs as I don't think what I am earning is relavent to them. We have sent proof to show that sister is on reduced salary due to being on sick pay. It just seems a ridiculous situation. Ok, so she fell into arrears (first time in her life) but it was not her fault that she got assaulted whilst carrying out her work.

    I've tried to reason with creditors, that myself and mum don't have to make payments but that we are trying to ease things for sister but they are just being so bloody awkward ............... aargh its so frustrating!!!!

    What kind of letter would be best to send to them now? I thought I had been quite direct and straight to the point with them but obviously not.

    ASk him for his letter. it may form a useful template.

    And an I &E might make things better. For your situation, a CCCS one would be a good idea as the allowances are industry recognised. Try the CCCS Debt_Remedy.

  • Well two months on and there is no change to the situation. Letters have been sent (recorded delivery) and have been received and now we are not even getting a response to our letters. This is getting more and more frustrating all the time, I feel these companies are just playing silly beggars now.

    Would anyone agree that perhaps we should just start making manual payments even though a sum has not been agreed. At least then perhaps if further action was to be taken, a judge or whoever would see that my sister has been making an attempt to resolve this situation?
