Currys can they ndo this?

On October the 20th 2007 I purchased a Dell Arco2 laptop from Curries. I did not purchase any special insurance and had the standard 1 year warranty.

The laptop was nothing but problems and we reported the following to curries and the tech guy did the repairs/Replacements.

31/07/08 :- Repaired the computer due to it crashing all the time they replaced the Keyboard & HDD
16/10/08 :- Went in again with a whole list of problems inc computer crashing and this time they replaced, HDD, Memory X2, Motherboard & AC adapter.
21/11/2008 :- Went in again and this time they replaced the keyboard.

The computer broke again just over 2 months ago and I thought damn it is now out of warranty. The screen was faded (no light) when the computer is turned on and is running. As I thought I had no warranty I went to a computer shop who told me that the lcd screen was fine and so was the inverter.

I was then told that this was going to be the motherboard as the screen work perfectly when it was bypassed (on another test). I was told if the computer was repaired within a year and the motherboard was previously replaced then this must carry 1 years warranty as it is a new part?

I rang currys up today and was told that the warranty on that repair on the 16/10/09 only lasts for 90 days and when I challenged them about the 1 year they stated this is not the case. I wonder about this as if I was to purchase a new part for my car this would have 1 years warranty from the manufacturer so why not in the case of a computer?

Has anyone got a legal answer on this one and one I hope I can challenge them with? (PS I have all the receipts showing the repairs and replacements they have made).

I also remember hearing I think it was on the one show about products legally having to stand up to the test of time (I think the Xbox was used as an example) I think they said 6 years would be suitable. This laptop hasn't lasted even 2 years yet!

    I thought surely a new product has to carry a warranty? If I was to add a new battery to my car it would have a 1 year warranty, without this battery the car would not run. This is the same situation as I am in with the laptop.

    No.

    But it does have to comply with the sales of goods act. A retailer does not have to provide a separate guarantee (hence why you always see the wording "does not affect your statutory rights"

    The SOGA says UP TO 6 years. That in no way means your laptop should be expected to last 6 years - just whatever is reasonable.

    Though it does sound like you have a good case for getting a repair anyway!

    You may have to go via Customer Services though, stores are pretty limited in what they can do with out-of-warranty products.
