Expert information required please
I got medically retired from work in 2003 and was awarded a pension with effect from 1st February 2006.
I have been claiming Disability Living Allowance at the middle rate since 2004
I have also been claiming incapacity benefit from the same time.
I have unfortunately made a mistake and forgot to notify the DWP (incpacity benefit and DLA people) that I was on a pension.
I suffer from mental illness and cannot use the phone.
I also get confused with beaurocarcy but I am honest as the day is long.
I informed the incapacity benefit people today, and they told me that you are allowed so much before they make deductions.
They said I will owe some outstanding money, and are going to send me a form, so I can put the monthly pension earnings down. They say that they will work out the amount owed and deduct it from my fortnightly benefits.
They reassured me I will not get into trouble, but will have to have the outstanding amount deducted.
I have not been able to get hold of the DLA people, and I am beside myself with worry, about reading a thread on here about DLA claimants being prosecuted.
Can I ask, will the same apply to the DLA, as above, or will they prosecute.
Its a genuine mistake and of course I am prepared to pay the money back.
I would really appreciate urgent reassurance please. I am paranoid, so I dont care if I sound a fool, I would rather that than be prosecuted.
thank you for your help

DLA is not means tested so you have no worries there.I made a mistake once, believeing people on the internet were my virtual friends. It won't be a mistake that I make again!0

Hello,
I am no expert, but the difference between DLA and any other benefit, is that DLA is non means tested.
So regardless of your pension, it should make no difference.

You are not going to get prosecuted so stop worrying!!
As above DLA is not means tested!
How much do you get a week for your pension?0 -

Thank you all, enormously, for your reassurance.
I would rather sound a worrier, than leave it and be worrying about being prosecuted.
I get, on average about 82 quid a week, its paid monthly, and the amount fluctuates, but not by much.
You have saved me a sleepless night.
thanks again.0 -
am i right in thinking that the pension has to be above £95 a week before it makes any difference. It was this in my OHs case
And the other posters are correct that DLA is not counted.
In which case you can have an even better night's sleep.
good luck and dont worry.make the most of it, we are only here for the weekend.
and we will never, ever return.0 -

My inapacity benefit is about 80odd a week and my dla is 40odd a week.alwaysonthego wrote: »wIt is £85 according to my copy of 'Advisers guide to benefits and Tax credits' (published by welfare benefits unit)
That blasted healy, beat me to it!
Am I right in assuming if DLA is not means tested, I only need to declare the incap, as i have already done, or do I need to be ringing the DLA to notfiy them as I am on incap too?
Can I rid myself of the procecution worry as the replies say above?

You do not need to inform DLA, they are not concerned with any pension.0
