how much is SSP?

    SSP doesnt have to be paid if the employer has a more generous scheme in place - which this employer seems to have - but the basic premise remains the same in that the six months full pay stops and then ESA can be claimed.

    It does, it's statutory. So full pay is basically (full pay - SSP rate) + SSP.

    It means nothing to employer or employee (unless the employer has very few employees and can claim it back).

    It wasnt SSP that was being received it was Occupational/Company Sick pay that was being received. SSP is the absolute minimum that can be paid (For those that qualify for it) but OSP can be paid to anyone at any time - as long as they are sick.

    We dont know that the OP's ex qualified for SSP but we do know that he qualified for OSP.

    Dookar is correct SSP will have been paid and included in the OSP.

    The DLA is based on his care needs not on his diagnosis. A diagnosis can help a bit, but it's not the main thing. He should definitely apply now if he has been continuously needing care for at least 3 months, and his mother should apply for carers allowance at the same time. Ther is nothing to lose, it sounds like he would certainly get it, it does not affect any other benefits and it will have no impact on his employment. It is a good idea to get expert help filling in the form e.g. from CAB.

    He or she should also contact local social services to see what help they can provide, e.g. help with bathing, equipment and adaptations and so on.

    His property should be exempted from council tax meantime if he lived there alone, on the grounds that he has gone elsewhere to receive care (doesn't need to be a hospital or care home). His local council will send him a form to fill in, if he contacts them.

    His mother sounds like she might need some support too. The Carers Trust is a good starting point, see https://www.carers.org , especially if this is all new to her.

    Employers may "opt out" of the SSP scheme providing that their scheme pays at least as much as SSP and for at least as long as SSP would be payable. However this does not mean that they can ignore SSP as they still have to keep records to show that the minimum amount was paid and the correct forms are issued if SSP is not due or when SSP finishes and the employee needs to see if entitled to ESA. In practise pretty much the same records must be kept whether you "opt out" or not.

    Hi, he is employed by the NHS if that makes a difference. Ill definately pass on your comments, thankyou very much. Ill get him to apply for DLA now as something will need to be in place for when he goes to half pay Hopefully he will make a miraculous recovery, but at the minute, I doubt it, at least not yet.
