    Yes they can take you to court, but it is unlikely that they would win. For £40, their solicitor might advise against it. It is more likely they will sell the alleged debt to a Debt Collector

    Keep an eye on your credit records, they might try and trash you there - and do as Old Grey Fox says - keep a copy. Once that happens, tha account is in dispute and you can keep the debt collectors away with the dispute. But you may have to follow the complaints process to the bitter wend, right to their independent complaints handler.

    Can anyone recommend a place where I can get legal advice about this? This is my third thread about Ellite calls, every time I think we've got rid, they crawl back up again.

    We finally cancelled our contract with Elite Calls in February this year. We paid everything that we owed them and went back to BT.

    In July Elite sent us another bill and a letter from their Credit Controller threatening legal action. Having pored over the bills I realised a mistake had been made (by us, but accepted by them at the time) and we did owe them £1. I spoke to their Credit Controller and managed to negotitate the payment down to less than £5 and we both agreed that would be in full and final settlement. I told her that I didn't agree we owed more than £1 but I would pay it if it was the last payment we would have to make and she agreed it was.

    I sent them a letter the same day outlining our telephone conversation and confirming that it was our final payment, but they never acknowledged the letter.

    Now in November they've sent another invoice. Made up of 40p for services on 1st March and £5 charges (£1 for printing the bill and £4 charge for not having a DD!!) plus VAT.

    Our contract ended with them in February and they are claiming they didn't cut our phone off until 2nd March, so these are charges for 1st March.

    I've written them a letter saying we owe them nothing, but I don't know how to find out our legal position. Don't want to phone them as they have a premium rate number (0844) and it cost us about £3 last time.

    Is there a site or somewhere I can go and find out how to deal with these people? I'm stumped.
