Once a WPO is signed the goods belong to the bailiff not to the debtor and they can call the police to effect entry.

this doesn't help but our local council where charging us twice until i pointed this out to them this morning with a 20 min phone call they readjusted our benefit, we had an installment plan with them paying last years bill which they cocked up my father and my 3 year old son have the same name so they disallowed the allowance for my little one and added our installment plan to this years bill as well but they where adamant they hadn't they said it was illegal for them to take it twice until i pointed it out to them,

they should not be allowed to get away with this harassment when they get it wrong it's upp's sorry when we fall behind it's a walking possession order and more cash and prison

They can only take tonight what is on the original WPO.

The problem might be that since they are in the house, they do another WPO for the other account. Do not sign it.

    Thanks everyone for the replies

They turned up tonight at about 6.30pm, I work for myself from home and wouldn't you know it a client arrived 15 minutes earlier...
Managed to separate the two, and sit in the kitchen with the bailiff, pretending he was another client...

bottom line is he's given us 24hrs. so 6pm tomorrow.

RAS, your post was the first that has responded to the walking order issue, National debt line etc couldn't advise.. because the council have thrown in / attached this years debt to it, which confuses the issue..

Do I have to sign before they can extend the walking Order? Its important because the original order was lenient.

I have so many issues at the moment that I feel like giving up, the irony is we're in repossession with the house, so I doubt we'll be living here for most of what they're now chasing us for

    Hi there,

apologies if i've posted in the wrong place.

We have an out standing Council tax bill from last year, we managed a few hit and miss instalments and then about 2 months ago we paid £550 after a second van visit, which has left the balance owing (including Bailiffs fees) at £950.

I've phoned the bailiff today to offer an immediate £140 with £200 to follow monday and the rest of the £950 by the end of next week. Unfortunately he said that they will be here at about 8pm this evening and that this years bill had now been added to it taking the balance to well over £2000

He has said that we need to pay last years £950 in full tonight or they will take the goods.

If you can find a substantial amount of money at short notice, is there no possibility you can start making regular payments towards this debt? Take your council tax bill down to the office with cash and pay the council direct. This could end up in court so it's really important you are seen to be making efforts to pay.

Sadly, the bailiff has been able to charge you additional fees because you had allowed him to come into your home to complete a Walking Possession.

It should be remembered that you do NOT have to allow the bailiff into your home.

In the first place it is VITAL that you contact the council to confirm the amount of the Liability Order.

Next you need to establish exactly how much the bailiff has charged you. His company MUST be by law provide this.

Can you PM me with the name of the bailiff so that I can search to ensure that he is certificated.

    Which company is this?

On the question of whether the bailiff can remove more goods. By agreeing to allow the bailiff to come into your home he has now levied upon goods and you will see on the Walkig Possession that you have AGREED between you that you can keep the goods on the premises but that if you fail to pay the amount requested.....then the bailiff can return to your home and use force if need be to remove those goods listed on the WP.

Sadly, the bailiff can use this opportunity to RE ENTER your premises and in doing so he can then once again levy upon more goods for the 2nd Liability Order.

Can you confirm what goods have been listed?
